New COVID-19 bill extends contractor reimbursement, but no new funding

WASHINGTON ― A bipartisan group of lawmakers has unveiled a $748 billion coronavirus relief proposal that includes an extension of a prized reimbursement program for federal contractors, but without the billions of dollars previously sought by defense firms.

Defense officials have warned they will need to tap modernization and readiness funds if Congress does not appropriate at least $10 billion for defense contractors' coronavirus-related expenses, as authorized by Section 3610 of the Coronavirus Aid, Relief, and Economic Security Act. However, the new proposal doesn't appropriate funding for the Section 3610 reimbursements.

Negotiations on a final relief deal are ongoing, but the package includes a Section 3610 extension through April 30, 2021. The provision applies to all federal agencies, but it has been of particular interest to the Pentagon and defense industry.

Added funding could come in the $1.4 trillion omnibus spending package for fiscal 2021, which is expected this week, or it could come with the next Congress and the incoming Biden administration in 2021. The defense industry has of late pushed for the extension of Section 3610 first, over added appropriations.

“You have people who can't feed their families, you have people who are going to get evicted, you have people whose unemployment insurance is going to run out. They need Congress to pass this legislation,” Arnold Punaro, National Defense Industrial Association chairman, said of the new bipartisan relief package.

“We prefer the defense industry have 3610, and we believe we'll have an opportunity with the new administration to make the case to them that it's still an important provision,” Punaro said, adding that the extension gives the incoming administration time to work on a “much more comprehensive approach.”

Fifteen defense companies implored Congress on Friday to extend the program. In a letter to congressional leaders, they argued the extension is needed to maintain national security, but also “thousands of critical employees who would be difficult to replace within the industrial base.”

“As COVID-19 rates hit record levels that were unanticipated not only when the CARES Act was enacted but just weeks ago, agencies are shifting work plans, reducing hours and taking other steps to ensure the health and safety of the workforce,” the letter stated.

The reimbursement window was extended until Dec. 18 under the continuing resolution Congress passed on Friday. Originally the support was to stop at the end of fiscal 2020 in September.

NDIA was among eight trade organizations that signed a Nov. 20 letter to Congress urging an extension of Section 3610. There have been a spate of similar letters from lawmakers to congressional leaders in recent weeks.

“The current authority has saved thousands of NASA and defense contractors from being furloughed,” Florida Republican Rep. Bill Posey said in a letter with nine other lawmakers. “If the authority is not extended, many contractors — through no fault of their own — will face dire economic and financial consequences if they are restricted again from conducting their regular work on a NASA center or defense program and may be limited or unable due to the nature of their work to do so through a telework alternative.”

Senate Intelligence Committee acting Chairman, Marco Rubio, R-Fla., and Vice Chairman Mark Warner, D-Va., pressed congressional leaders earlier this month to extend Section 3610.

“Section 3610 has proven to be an important means of providing necessary relief during the pandemic to critical Intelligence Community industry partners ― and particularly to small businesses that provide highly specialized capabilities ― to retain key national security capabilities,” they said in a joint letter.

    Boeing has given an F/A-18 a new lease on life after delivering the first Super Hornet under the service life modification program to the U.S. Navy. The second SLM jet will be delivered by the end of the month, and Boeing will deliver the third F/A-18 in April. The initial Super Hornets delivered from the program will extend the service life from 6,000 to 7,500 flight hours. Future modification plans in the early 2020s will enable the jets to fly 10,000 hours and incorporate the new Block III capabilities. “SLM is going to provide a critical resource for the Navy to re-capitalize on long-serving aircraft to return them to the fleet in a near new condition,” said Capt Stephen May, PMA-265 co-lead for E/F/G Air Vehicles. “It will reduce burden on our maintainers, our supply system and our depot level assets within the enterprise.” There are now 15 Super Hornets in the SLM program on production lines in St. Louis and San Antonio. It takes 18 months to complete modifications on an F/A-18, although that time will be driven down to one year as the program progresses. Boeing will deliver five more Super Hornets this year. The Block III conversion will include enhanced network capability, conformal fuel tanks, an advanced cockpit system, signature improvements and an enhanced communication system.     Gripen F Fighter Production Under way

    March 26, 2020 - Saab has performed the first metal cut for the two-seater fighter aircraft Gripen F, marking an important milestone in the programme. Gripen F is under development for the Brazilian Air Force (FAB) and shares the same advanced design and features as Gripen E, but with seat, displays and controls for a second crew member. Gripen F has both a training mode for tuition of one crew member and a mode whereby the two crew members can share the workload with different display settings. The first part was manufactured recently at Saab's facilities in Linköping and is for the air duct section, just behind the cockpit of the aircraft. “This milestone is important for the Gripen project because it demonstrates that the development phase is proceeding properly. This signals the beginning of the production of the two-seater aircraft, Gripen F, which is much anticipated by the Brazilian Air Force,” says Colonel Renato Leite, head of the Monitoring and Control Group (GAC-Saab) at the Brazilian Air Force. The joint industrial programme on Gripen F is between Saab and the Brazilian partner companies Embraer, AEL Sistemas, Akaer and Atech. Currently, approximately 400 engineers are working with the development of Gripen F, mainly at Gripen Design and Development Network (GDDN) at the Embraer plant in Gavião Peixoto, São Paulo State, Brazil. Manufacturing will take place both in Sweden and in Brazil. “Very effective teamwork among many dedicated people, both in Sweden and in Brazil, paved the way for this milestone on this new version of Gripen. These kind of milestones are special moments due to their rarity and that feels great,” says Jonas Hjelm, head of Saab business area Aeronautics. Brazil has ordered 28 Gripen E fighters that will be delivered to Brazil starting from 2021 and eight Gripen F fighters, starting from 2023.     Army Wants Industry Input For Reliable Exoskeleton (Not Iron Man, Yet!)

But Army experiments with more modest lower-body exoskeletons have shown real-world potential to help overburdened foot troops. WASHINGTON: Army Futures Command is drafting a formal requirement for a military exoskeleton and will seek feedback from manufacturers at a November industry day. The Army's top priority, officials told me: rapidly prototyping a system that helps the wearer “move faster, travel further, and carry heavier loads” – without breaking down in the heat of battle. “Reliability is a huge issue that needs to be resolved,” said Ted Maciuba, deputy director of robotic requirements for Futures Command. Now, don't expect a full-body bulletproof suit that can fly and access huge databases out of science fiction. “We are not going after the Starship Troopers/Iron Man system right off the bat,” said Rich Cofer, a former soldier who's now the Army's lead “capabilities developer” on the exoskeleton project. “We're not going to jump right in and expect Tony Stark... Expectation management is key.” (That's a stark contrast to Special Operations Command's highly publicized TALOS program, which explicitly compared itself to Iron Man but produced nothing of the kind). So instead of Iron Man, think Iron Leg. In a “soldier touchpoint” last December at Fort Drum, NY, Army soldiers from more than two dozen Military Occupational Specialties — ranging from infantry to supply — tried out various types of “lower-body exoskeletons,” including the Lockheed Martin ONYX that our own Paul McLeary tries out in this video. In essence, these are motorized knee braces and other wearable reinforcements for the legs that lighten the load on overburdened soldiers as they march for hours with heavy packs, manhandle artillery shells and such. The goal isn't to give the wearer superpowers, but to reduce fatigue and risk of injury. During the Fort Drum trials, “there were significant increases in the effectiveness of soldiers,” Maciuba told me. “The soldiers were able to do more with the exoskeleton than they could without.” That said, “we learned [that] there needs to be enough reliability engineered into our systems so that there is a very high probability they will not fail in use,” Maciuba continued. “It's one thing to be wearing a boot whose sole flips off. You can always take some 100-mile-an-hour tape and tape that back on your foot. It's another thing to be wearing an exoskeleton” that requires specialized training and tools to fix. So reliability will be a high priority when the Army speaks to potential vendors in mid-November. By that point, Maciuba & co. expect to have a draft Abbreviated Capabilities Development Document for industry to review and offer comment on. (Army Futures Command officially gave them the go-ahead to write the ACDD on Aug. 14th; the exoskeleton project falls under the command's Soldier Lethality team, with input from PEO-Soldier acquisition officials, Natick Soldier Systems Center researchers, and capability managers for infantry, armored, and Stryker units). While unclassified, the document will be considered sensitive and only released to qualified contractors. While the ACDD is formally considered a requirements document, Maciuba told me, it's not going to set rigid technical specs as would a traditional Army requirement. The technology is advancing way too fast to get that detailed at this early stage. Instead, he said, it will outline “desirable characteristics” but leave industry plenty of leeway to innovate on specific ways to achieve them – and the Army is open to revising those desires based on what industry says is actually achievable. “We want industry to grade our work,” Maciuba said. The industry day – which will be held online unless there's some miraculous breakthrough with COVID-19 – will include both a general session open to all contractors and one-on-one meetings with specific contractors so they can discuss their technology without competitors listening. Afterwards, Maciuba, Cofer, & co. will compile the feedback from all the companies, revise the ACDD, and send it to Army leaders for approval. The final Abbreviated Capabilities Development Document should be out by the end of 2021, Cofer estimated. The next step?
