    Armed Services committees and the election: Here’s what we know

    By: Joe Gould WASHINGTON — As results for key congressional races and the presidency continue to roll in, several Senate Armed Services Committee leaders are still battling tough races. But here is what we do know, as of mid-morning Thursday. This story will be updated as results come in: • Georgia Republican Sen. David Perdue, the chairman of the Seapower Subcommittee, is leading in his race against Democrat John Ossoff, potentially denying Democrats what would have been a vital pickup for seizing control of the Senate. It's also too soon to call the race between Vice President Joe Biden and President Donald Trump for the state's 16 electoral votes. Democratic hopes of controlling the Senate for the first since 2015 appear to be slipping. To win the Senate, Democrats would have to gain three seats if Biden prevails against Trump, or four seats if Trump wins the election. • Senate Military Personnel Subcommittee Chairman Thom Tillis, R-N.C., led challenger Cal Cunningham by 96,000 votes and declared victory Wednesday, but Cunningham refused to concede while more than 117,000 absentee ballots were outstanding. • Senate Readiness and Management Support Subcommittee Chairman Dan Sullivan, R-Alaska, on Thursday morning appeared to have a 60,000-vote lead on Independent challenger Al Gross, with only half the votes counted. However, Alaska's tally is expected to take days as officials count mail-in ballots. • Sen. Joni Ernst, R-Iowa, had a similarly tough race but denied Democrats what would have been a key pickup for seizing control of the Senate. Ernst, the Emerging Threats and Capabilities Subcommittee chair and a member of Senate Republican leadership, is the first female combat veteran elected to Congress. • Michigan Democrat Sen. Gary Peters, the ranking member on the Emerging Threats and Capabilities Subcommittee, prevailed Wednesday night in a razor-tight race against businessman and Iraq war veteran John James. Hours after Biden defeated Trump in the state, Peters was roughly 60,000 votes ahead. • Senate Armed Services Committee Chairman Jim Inhofe, R-Okla., and ranking member Sen. Jack Reed, D-R.I., both won reelection handily, and if the Senate stays in Republican hands, they will almost certainly stay in their leadership roles. Senate Airland Subcommittee Chairman Tom Cotton, R-Ark., had no Democratic challenger and won reelection. Senate Cybersecurity Subcommittee Chairman Mike Rounds, R-S.D., also won. New Hampshire Democrat Sen. Jeanne Shaheen, another senior member of SASC, easily won a third term. All three were projected wins. • SASC Republican Sen. Martha McSally, the Air Force's first female fighter pilot to fly in combat, lost to Mark Kelly, an astronaut and retired Navy captain, in Arizona. She has yet to concede, however. • SASC Democrat Sen. Doug Jones, D-Ala., lost decisively to Republican opponent Tommy Tuberville. • House Armed Services Committee Chairman Adam Smith, D-Wash., soundly defeated his Republican challenger, while two lead Republican contenders to replace Rep. Mac Thornberry, R-Texas, as ranking member ― Reps. Mike Turner of Ohio and Mike Rogers of Alabama ― also won reelection. • Two Democratic freshmen on HASC ― Reps. Kendra Horn of Oklahoma and Xochitl Torres Small of New Mexico ― lost seats that Democrats flipped in 2018. As of Wednesday afternoon, Rep. Anthony Brindisi, D-N.Y., was trailing his Republican challenger but refused to concede until absentee ballots are counted. • Nebraska Republican Rep. Don Bacon, a former Air Force one-star general whose policy positions sometimes clashed with Trump, carved out a reelection win. Because Nebraska awards its electoral votes by congressional district, NE-02 was also a crucial win for Biden. • Rep. Elissa Slotkin, D-Mich., won reelection. Slotkin, a former CIA analyst and Pentagon official, is at the top of an influential class of Democratic freshmen who have hands-on national security experience. By THERESA HITCHENSon June 03, 2020 at 12:48 PM WASHINGTON: The Trump administration should unilaterally declare that it will no longer subject drone sales to export control restrictions under the Missile Technology Control Regime (MTCR), says a new Mitchell Institute study. And Congress should use the 2021 National Defense Authorization Act (NDAA) to redefine unmanned aerial vehicles (UAVs) as aircraft, which not only remove them from MTCR restrictions but also would ease US domestic export controls, asserts the paper, “”Modernizing UAV Export Policy for Effective Coalition Forces,”. “The US Congress should craft language in the 2021 NDAA that defines UAVs as aircraft, not cruise missiles, but as aircraft, and subject to the same export considerations as any other military aircraft,” said Heather Penny, senior resident fellow at Mitchell and the paper's author, during a webinar today. “We believe that this language, a statute, would be sufficient to be able to remove UAVs from being subject to the MTCR guidelines.” The 35-nation MTCR agreement requires a “strong presumption of denial” for sales of so-called Category 1 drones — those that can carry a 500 kilogram payload more than 300 kilometers. The Category 1 definition is considered as the minimum capability a missile needs to carry a nuclear warhead. Smaller unmanned aerial vehicles also are covered under MTCR's Category 2 rules, but those export restrictions are less stringent. Even the treaty-hating Trump administration sees the MTCR — a political agreement rather than a treaty — as a key tool in preventing the proliferation of ballistic and cruise missiles. This is despite its long-standing efforts to ease drone sales to allies, including through revamping US domestic law to allow “Direct Commercial Sales” by companies, rather than requiring all sales to go through the formal Foreign Military Sales process that requires approval by DoD, the State Department and Congress. Indeed, over the past year the administration tried — and failed — to convince its MTCR partners to revamp the rules to allow drones flying less than 800 kilometers per hour to slip out from under the Category 1 rules, said Penny. Washington is now expected to try again at the annual MTCR signatories meeting, she said, instead suggesting a 600 kph speed limit as the line of demarcation between the two categories of export restrictions. (The meetings are usually held in the fall, although there has yet to be an announcement of the 2020 dates.) But, Penny argued, even if this new effort comes to fruition, it would fail to fix the underlying problem of allowing allies to buy high-end US combat drones — and preventing them from fully integrating with US operations. Secondly, she asserted, complying with MTCR rules “distort the market” in favor of Chinese sales, she said, since China is not a member of the MTCR and has few formal restrictions on arms exports. “Continuing to adhere to and apply MTCR guidelines to UAVs facilitates Chinese strategic interests,” Penny said. “It's working against US interests.” Keith Webster, former DoD head of defense cooperation, agreed — calling efforts to revise the MTCR as a “Band-Aid” that would soon loose viability because of the rapid pace of technology improvement. “I wish we would act unilaterally,” he told the Mitchell Institute webinar. “We have the ability to act unilaterally. And I would like to see us do so very soon. I have great hopes that this administration, with its bold unilateral actions on so many fronts, would take unilateral action with this regime on UAVs.” That doesn't mean, Webster hastened to add, pulling out of MTCR itself. “Stay in the MTCR,” he said. “It served its purpose.” The experts acknowledged that a unilateral US move to exempt UAVs from MTCR could spur other nations to do the same for their own weapons systems that could exacerbate nuclear proliferation. Penny stressed that it was key for the US to renew its commitment to nonproliferation of ballistic and cruise missiles, and support MTCR's rules for those systems. Saying that “we need to be honest with ourselves about the implications” while seeking “creative solutions” to the UAV issue, Webster seemed to suggest that ultimately the US may decide the MTCR itself isn't worth the trade off. “There are challenges with compliance within the regime with at least one member,” he warned. As Breaking D readers know, US military leaders and Congress have sounded the alarm on the proliferation of cruise missiles by Russia (an MTCR member) and China that can more easily slip through US ballistic missile defense systems.     Northrop Grumman Awarded Recapitalization Contract to Provide Continuous Secure Communication in Polar Region

    REDONDO BEACH, Calif. – July 3, 2019 – Northrop Grumman Corporation (NYSE: NOC) has been awarded an $82 million contract by the U.S. Air Force to facilitate military satellite communications in the Earth's north polar region through its Enhanced Polar System Recapitalization (EPS-R) Control and Planning Segment (CAPS) program. Northrop Grumman is the provider for all three major components of the EPS-R CAPS program demonstrating the company's industry-leading end-to-end capabilities. The U.S. Air Force's EPS provides secure, jam-resistant satellite communications coverage to forces in the North Polar Region (above 65 degrees north latitude) in support of national objectives. CAPS is a next-generation ground system that receives telemetry and supplies configuration commands, mission planning and cryptographic planning for the EPS and EPS-R polar-orbiting payloads. Northrop Grumman successfully developed, built and delivered the EPS CAPS for the U.S. Air Force Military Satellite Communications Systems Directorate (MILSATCOM) on a previous contract. The Authority to Proceed granted by this contract award includes the development of software for the EPS-R CAPS taking the program from requirements analysis to test and delivery. The contract also addresses international host accommodations provided by Space Norway for new out of band link functions, cyber architecture, orbit planning, and the capability for controlling two additional EPS-R Payloads on a single software baseline in addition to the two existing EPS Payloads. “Northrop Grumman is committed to delivering the critical ground segment technologies that support the important mission of U.S. Air Force Space and Missile Command," said Rob Fleming, vice president, strategic force programs, Northrop Grumman. “We demonstrate through this contract and in close collaboration with Space and Missile Command that existing ground design and software can be successfully modified to support new and advancing mission requirements, an important strategic priority for our customer.” Work will be performed in Redondo Beach, California and Colorado Springs, Colorado, and is expected to be completed by September 30, 2023.
