Two U.S. senators called on the Office of Management and Budget to ensure that federal regulation banning the government's use of Chinese telecommunications technology include “explicit processes” to help small businesses with compliance.
In a May 4 letter sent to acting OMB Director Russ Vought, Sens. Marco Rubio, R-Fla., and Ben Cardin, D-Md., asked Vought to carefully consider to the needs of small businesses while the agency reviews a proposed rule.
The senators' concern is in response to a proposed rule under review by OMB implementing Section 889(a)(1)(B) of the fiscal 2019 defense policy law — a provision that bans federal agencies from procuring or doing business with companies using “covered telecommunications equipment or services" in an effort to block Chinese tech companies like Huawei and ZTE from entering the U.S. government's supply chain.
Rubio and Cardin are the top two senators on the Senate Committee on Small Business and Entrepreneurship.
According to the letter, OMB is currently reviewing the draft proposed rule, statutorily required to be implemented Aug. 13. Because smaller companies don't have access to the same resources as larger suppliers, they may need “more assistance and time,” the senators wrote. The pair called the guidance for small businesses “vita,l” given that small businesses make up about one-quarter of federal procurement, worth $120 billion.
“By providing these small firms with a clear path toward compliance and a reasonable time frame, we believe that the goal of securing the United States supply chain will be better achieved,” Rubio and Cardin wrote.
Outside interest groups representing federal contractors have also pushed Congress to delay the implementation of Part B of Section 889. In a joint letter in late March, the National Defense Industrial Association and the Professional Services Council asked Congress to delay the Aug. 13 date to February 2021. They also cited the ongoing coronavirus pandemic as reason for a delay.
“Part B will impose significant financial and operational costs on medium and small-sized firms at a moment of substantial uncertainty and hardship. While we agree that Part B addresses a significant problem in defense supply chains, and that additional measures are needed to protect [Department of Defense] information assets from covered equipment, COVID-19 has made the current implementation timeline infeasible,” the groups wrote.
The United States government alleges that Huawei's 5G technology allows for Chinese government espionage and poses a threat to national security. Senior U.S. officials have traveled the globe, urging allies not to include Huawei's technology in their 5G networks. But the effort has been largely unsuccessful, particularly after the United Kingdom announced in January it would allow Huawei to build noncritical pieces of its 5G network. That decision was met with scorn by lawmakers on Capitol Hill.
Still, Rubio and Cardin warned that OMB needs to produce the regulation cautiously and carefully.
“We are concerned that if the regulatory implementation language fails to adequately consider small businesses, this process could not only result in an ineffective implementation of the prohibition, but also be both harmful and costly to thousands of small federal contractors,” they wrote.

Nathan Strout The National Reconnaissance Office successfully launched four classified payloads into orbit July 15 from NASA's Wallops Flight Facility — the agency's first dedicated launch from the Virginia facility. NRO is in charge of acquiring, launching and operating the nation's intelligence satellites, and while the agency does not typically reveal the details or purpose of its classified satellites, the agency's director noted that the four payloads will demonstrate revolutionary capabilities. “NROL-129 represents a collaboration between the NRO and our industry partners to design, build, launch and operate a system of satellites that will demonstrate revolutionary capabilities of value to the nation and our allies,” said NRO Director Chris Scolese. “Despite facing challenges in 2020, we have found new and better ways to collaborate with our partners from a distance, relentlessly pursuing our mission and denying sanctuary to our adversaries.” The four NRO-built payloads — dubbed NROL-129 — were launched aboard a Northrop Grumman Minotaur IV rocket at 9:46 a.m. ET. This was NRO's first launch with a Northrop Grumman Minotaur IV, a rocket capable of delivering payloads of up to 3,814 lbs into low Earth orbit. The first three stages of the four stage, 78-foot tall rocket utilize solid rocket motors taken from decommissioned Peacekeeper ICBMs. The launch was acquired under the U.S. Air Force's Orbital/Suborbital Program-3, a contract mechanism built to take advantage of the growing commercial small launch sector. This was NRO's third launch of 2020 and its first to take place on U.S. soil. The previous two launches, taking place respectively in January and June, were launched aboard Rocket Lab Electron rockets from the company's New Zealand facility. Nathan Strout WASHINGTON — The U.S. Space Force has completed upgrades to the Global Position System's ground segment that will allow it to partially use a new military GPS signal known as M-code, the service announced Aug. 6. While the new anti-spoofing, anti-jamming, encrypted M-code signal has been available on many GPS satellites for years, the military has not had the corresponding ground and user equipment to access and leverage it. The $6.2 billion Next-Generation Operational Control System, or OCX, being built by Raytheon Technologies for that purpose is five years behind schedule and isn't expected to be delivered until June 2021. To provide access for war fighters in the interim, the Air Force awarded Lockheed Martin a contingency operations contract in 2016 to build an M-code upgrade to the current GPS Operational Control System. That M-Code Early Use upgrade will allow war fighters with the appropriate equipment to use some aspects of the new military signal until OCX is ready. M-Code Early Use was delivered in June 2019, entered a trial period in October and was approved for everyday use in March 2020. The M-Code Early Use hardware and software upgrades were completed July 27, clearing the path for the system to enter the operational acceptance phase in November 2020. Installation took place at the master control station at Schriever Air Force Base, Colorado and the alternate master control stations at Vandenberg Air Force Base, California. The upgrades allow OCS to task, upload and monitor M-code on the GPS constellation and will support testing and fielding military ground user equipment that can receive the signal. “Working closely with Lockheed Martin and our other mission partners — with the common national goal of providing enhanced [positioning, navigation and timing] signal security and safety always in sharp focus — means we're able to deliver the right mission capability faster to our warfighters,” said Lt.
