The plan was rolled out with much fanfare at the end of last year because the air force has faced — in the words of Defence Minister Harjit Sajjan — an "urgent capability gap" and is not able to meet its NATO and Norad commitments at the same time. Pat Finn, who is in charge of the materiale branch of National Defence, told CBC News in a recent interview a final agreement is still months away. He is confident, however, everything will come together. Delivery is "staggered over three years," Finn said. The Trudeau government announced in December it would buy 18 used Australian "classic" FA-18s as an interim measure to bolster the air force until the entire Canadian fleet of CF-18s is replaced, beginning in the mid-2020s. It had wanted to buy brand new Boeing Super Hornets, the newer, bigger, more advanced version of the FA-18 and CF-18. The plan was scuttled when the manufacturer, Chicago-based Boeing, filed a trade complaint against Canadian aerospace giant Bombardier. No price tag for the Australian deal was released at the time of the formal announcement, which was made by Sajjan and Public Works Minister Carla Qualtrough. Ongoing discussions Finn said those details are still being worked out. The Liberal government said in December the first used fighters, which were purchased by Australia around the same Canada bought its CF-18s, would arrive by January 2019. Finn said the delivery schedule is being finalized, but he anticipates receiving the first two warplanes by the summer of that year. Another one would follow by the end of the year, but much depends on the Royal Australian Air Force and how quickly it retires the fighters and the age of what's being offered. "They, of course, release aircraft as they get aircraft," Finn said. "We do not necessarily want the oldest aircraft, so we would like to have an ongoing discussion." He said there is some flexibility and if "summer '19 turns into" something a few months later because they can get a better jet, then it's something that can be negotiated. The Australian government is in the process of seeking permission to sell the planes because they were originally manufactured in the U.S. Once the Australian warplanes arrive in Canada, they will need to be given life-extension modifications that will bring them up to the standard of the CF-18s, which have been modified to continuing flying until 2025. It stands in stark contrast to the urgency with which the Liberals initially painted the shortage of fighter aircraft. "In 2025, the CF-18s will not be able to fly, and it is important that we move very quickly in filling this capability gap." said Sajjan in June 2016. Finn said the air force is managing the capability gap by making more CF-18s available for operations on a daily basis. "We're basically working right now to increase the availability of our current airplanes," he said. Experts say that would mean pouring more than expected into the maintenance budget in order to keep fighters on the flight line. Urgent purchase? One defence analyst said the government has a strange definition of urgent. "Nothing about the handling of this file lines up with the identification of it as an urgent need, either the interim or the permanent purchase," said Dave Perry, an expert in procurement at the Canadian Global Affairs Institute. He said he believes it will present a political headache for the Liberals come the next election. "The fact that this government may, at best, have a couple of second-hand aircraft before the next election after having identified an urgent need to acquire new fighter aircraft is just incredible," he said. When the Australian deal was announced, the government also laid out a timeline for the full replacement of the CF-18s, which were purchased in the 1980s, but extensively modified and upgraded in the early 2000s. Public Works recently held a consultation day with defence contractors, but Perry says no one seems to understand why it will take until the early 2020s to launch the competition. When the former Conservative government was struggling over whether to buy the F-35 stealth fighter, it conducted extensive research on the alternatives and possible types of warplanes Canada would need.     By James Careless How well is Canada's defence procurement actually working, and are industry-boosters like ITBs paying off? These and other questions were tackled at the ‘Defence in the 43rd Parliament' one-day conference on November 20, 2019. It was staged by the Canadian Global Affairs Institute (CGAI) at the Chateau Laurier hotel, before a full house in the Adam Room. During the opening session, ‘Canadian Defence Procurement – The State of the Union', DND Associate Deputy Minister Claude Rochette was cautiously upbeat about the state of Canadian defence procurements. In the last year, DND has signed about 12,000 contracts and spent about $6 billion on procurements, he said. Most of these contracts were on time and on budget. 2019's defence procurement spending is up from $4.9 billion spent by DND in 2016, Rochette noted. In addition, this year DND will “close out its budget” by spending its allocated funds, he said. Despite some criticisms that Canadian defence procurements are not moving fast enough, “we are doing pretty well,” said Claude Rochette. But the process isn't perfect, he admitted. “We have more work to do.” Rochette's positive assessment was echoed by PSPC Associate Deputy Minister Michael Vandergrift. 2019 “has been a very busy time” in Canadian defence procurement, he said, During the past year, the federal government issued an RfP for the Future Fighter Capability project; sole-sourced Light Armoured Vehicles from General Dynamics Land Systems-Canada; and selected Lockheed Martin to built 15 Canadian Surface Combatant ships. Asked which defence procurements are going well and which are posing challenges, Rochette replied that smaller projects that fall within DND's $5 million spending authority are easy to manage. Where issues crop up is in large multi-million dollar projects with long time lines: Trying to cost them accurately and manage them effectively is akin to asking, “I want to have a car and buy it next year, so tell me how much I'll pay for it (right now),” he said. In a later morning session entitled, ‘Offsets – Is the ITB Policy Delivering?', the panel considered the impact of procurement bidders ‘overcommitting' to ITBs (promising financial benefits worth more than the contracts they are bidding for) on the Canadian defence industry. Such ITB overcommittments, which can be worth 300% or more than the contract being sought, are “introducing unnecessary risk” in the Canadian defence industry, said Rich Foster, Vice President of L3 Harris Technologies - Canada. The result of overcommitting is that contractors are “now focussed more on quantity than quality” in making their procurement decisions, he said. The real victims of ITB overcommittments are SMEs, which lack the resources available to large companies to pay for these big ITBs. The choice facing these SMEs is to directly/indirectly seek such contracts – which can run 20-40 years – “or you go out of business,” said Brian Botting, Director of Strategic Offsets at General Dynamics Missions Systems. “It is a terrible dilemma for them to be in.” The CGAI procurement conference ended with the panel discussion, ‘Defence Procurement Canada'. This is the name of the integrated procurement agency the Liberals proposed during the October 2019 election, to replace the multiple ministries currently sharing this responsibility. The common sense reason for having a single defence procurement agency comes down to human nature: “If you ask two of your kids to take out the garbage, it won't get done,” quipped Alan Williams, President of The Williams Group. “If you ask one of your kids, maybe it will get taken out.” He explained that sharing procurement among ministries causes requires agreement between multiple ministers and deputy ministers – which wastes time -- and that Canada's military allies manage their procurements through single agencies. Creating a separate Defence Procurement Canada (DPC) agency would not be easy, said Jim Mitchell, Research Associate with the University of Ottawa's Graduate School of Public and International Affairs. Speaking from his own government experience, Mitchell observed that such changes are “disruptive, costly, difficult, hard on people, and hurt efficiency and effectiveness for a few years.” Mitchell added that creating DPC would not prevent Treasury Board and other ministries from having a role in defence procurement afterwards. CGAI Fellow Gavin Liddy was just as pessimistic about the value of creating DPC when so many defence procurements are underway. If the government wants “to do one single thing to delay the procurement agenda in the next five to seven years,” then they should instruct defence bureaucrats to create the DPC, Liddy concluded. “Nothing would divert their attention more than doing that.” http://www.canadiandefencereview.com/news?news/2765

    Howard Solomon Canada's electronic spy agency will soon get new authority to launch cyber attacks if the government approves legislation that is in the final stages of being debated. There's a good chance it will be proclaimed before the October federal election. But a discussion paper issued Wednesday by the Canadian Global Affairs Institute says Canadians need to debate the pros and cons of using this new power. “This direction not only opens up new possibilities for Canadian defence, it could also represent significant new risks,” says the report. “Without good answers to the difficult questions this new direction could raise, the country could be headed down a very precarious path.” Among the possible problems: Cyber retaliation. Another: While Canada might try to target a cyber attack, the impact might be bigger than expected — in fact, it might boomerang and smack us back. Third is the lack of international agreement on the use of cyber weapons (although this is a double-edged sword: Without an agreement there are no formal limits on what any country is forbidden from doing in cyberspace). “To move forward at this point to implement or even formally endorse a strategy of cyber attack would be risky and premature,” concludes the report's author, computer science professor Ken Barker, who also heads the University of Calgary's Institute for Security, Privacy and Information Assurance. “There are challenging technical controls that must be put in place as well as a critical international discussion on how cyber weaponry fits within the rules of war.” Barker's paper is in response to the 2017 strategy setting out Defence Department goals, where the possibility of Canada having a cyber attack capability first raised. It wasn't written with Bill C-59 in mind — now in its final stage before Parliament — which actually gives Canada's electronic spy agency, the Communications Security Establishment (CSE), the power to use what's called “active” as well as defensive cyber operations. In an interview Tuesday, Barker said “in the desire to push this thing they need to have more carefully thought about the questions I raise in this paper.” “Maybe it's late, but at least it's available.” He dismisses the argument that by announcing it has an offensive cyber capability Canada will cause other countries to think twice about attacking us with cyber weapons. “They would attempt to find out what Canada is doing to create cyber attack capabilities,” he argued. “One of the risks once we do endorse this,” he added, “is we open ourselves up to other countries to using Canada as a launching pad for cyber attacks to cover up their involvement, and [then] say ‘That was done by Canada.'” Nation states are already active in cyberspace. Ottawa has blamed China for the 2014 hack of the National Research Council, Washington suspects China was behind the massive hack of employee files at the Office of Personnel Management, and there is strong evidence that Russia mounted a sophisticated social media attack against the U.S. during the 2016 federal election. According to the Australian Strategic Policy Institute, The U.S. the U.K. and Australia say they have used offensive cyber operations against the Islamic State. The U.S.-based Council on Foreign Relations notes that Germany increased its offensive cyber capability after a 2016 attack on the country's legislature blamed on Russia. Last year the New York Times reported the U.S. Cyber Command has been empowered to be more offensive. Meanwhile in April the CSE warned it's “very likely” there will be some form of foreign cyber interference during the run-up to October's federal election here, The most commonly-cited interference in a country were two cyber attacks that knocked out electrical power in Ukraine — in December 2015 and again in December 2016 — largely believed to have been launched from Russia. All this is why some experts say Canada has to have an offensive cyber capability to at least keep up. In January, Ray Boisvert, former assistant director of the Canadian Security Intelligence Service (CSIS), told a parliamentary committee that “the best defence always begins with a good offense ... “When more than five dozen countries are rumoured to be developing active cyber capabilities, in my view that means we must develop capabilities to respond and in some cases that includes outside our borders.” Background In 2017 the Trudeau government announced a new defence strategy that included the promise of “conducting active cyber operations against potential adversaries in the context of government-authorized military missions.” The same year the government introduced Bill C-59, which in part would give the CSE, which is responsible for securing government networks, the ability to take action online to defend Canadian networks and proactively stop cyber threats before they reach systems here. This would be done as part of new legislation governing the CSE called the Communications Security Act. That act would give CSE the ability to conduct defensive and “active” cyber operations. Active operations are defined as anything that could “degrade, disrupt, influence, respond to or interfere with the capabilities, intentions or activities of a foreign individual, state, organization or terrorist group as they relate to international affairs, defence or security.” Both defensive and active cyber operations can't be used against any portion of the global information infrastructure within this country. And they have to be approved by the Minister of Defence. C-59 has been passed by the House of Commons and slightly amended by the Senate. It was scheduled back in the House last night to debate the Senate amendments. Despite all the cyber incidents blamed on nation states, Barker is reluctant to say we're in an era of low-level cyber war right now.
