Bidding criteria for Canada's $19B fighter jet competition will emphasize strategic attack and ground-strike capabilities — seeming to favour the F-35

The criteria that will govern the selection of the winning bid to provide Canada's next fleet of fighter jets will prioritize strategic attack and foreign ground-strike capabilities, according to government documents obtained by Postmedia — guidelines that are seen to favour Lockheed Martin's controversial F-35.

In 2010 the Conservative government under Prime Minister Stephen Harper selected the F-35 to replace the Canadian Forces' aging CF-18s, but later abandoned the plan after concerns about the technology used for the plane and its growing cost. During the 2015 election campaign Justin Trudeau promised that a Liberal government would not purchase the F-35, at the same time vowing to hold an open competition for the purchase of the country's new jet. Once in office, however, the Liberals backed away from their promise to freeze out the F-35 and the aircraft is now seen as a front-runner in the upcoming competition, with many supporters in the Royal Canadian Air Force.

Though the Liberal government has highlighted the need to buy new jets to protect Canadian airspace and meet the country's commitments to NORAD, the procurement criteria obtained by Postmedia, currently in draft form, indicate the bidding process will assign additional weight to aircraft that excel at ground attack for overseas operations.

Those criteria are seen to favour Lockheed Martin's F-35 stealth jet, say industry representatives allied with Lockheed's rivals in the upcoming $19-billion competition. The evaluation criteria also place less emphasis on sustainability — something else that may play to the advantage of the F-35, which has been dogged by high maintenance bills.

But Pat Finn, the Department of National Defence's procurement chief, says there is such a wide variety of requirements to meet in the competition that while some aircraft might be seen to do well in some areas, they may not excel in others. “Somebody may be better in a high-end scenario but they're worst for cost,” Finn explained. “That's why we say it's the whole piece” that will be considered in the competition.

At this point four aircraft are expected to be considered: two U.S.-built aircraft, the F-35, and the Super Hornet, and two European planes, the Eurofighter Typhoon and the Gripen.

Finn said bidding companies must meet mandatory requirements when it comes to long-term sustainment of the planes.

But industry representatives, both from Lockheed Martin rivals and those not directly involved in the competition, point out that beyond the mandatory requirements there is little emphasis on the important area of long-term maintenance and sutainability. So a company with an aircraft that costs relatively little to maintain won't get that recognition in the competition, they claimed.

Finn said discussions are still ongoing with various companies and their feedback is being assessed. The request for proposals, which will outlined the final requirements for the aircraft, is expected to be released around mid-July, he added.

Royal Canadian Air force commander Lt.-Gen. Al Meinzinger said key capabilities for a new plane are survivability and having an operational advantage. “We are very confident we are actually meeting the requirements of NATO and NORAD,” he said, pointing to the requirements for the new aircraft. “Both of those missions are well represented.”

Canada already changed some of the industrial benefits criteria of the competition in May to satisfy concerns from the U.S. government that the F-35 would be penalized or couldn't be considered because of how that program was set up.

U.S. officials had warned that the F-35 development agreement Canada signed years ago prohibits partner nations from imposing requirements for industrial benefits. Under the F-35 agreement, partner nations such as Canada are prohibited from demanding domestic companies receive contracts for work on the fighter jet, those companies instead having to compete for work. Over the last 12 years, Canadian firms have earned more than $1.3 billion in contracts to build F-35 parts.

The changes made in May would now allow some of those F-35 contracts to be considered when weighing the industrial benefits offered by the planes.

The winning bidder will build 88 jets for Canada, and the first delivery is expected in the mid-2020s with the full capability available in the early 2030s, according to documents produced by the Department of National Defence.

    Deal allows Canada to continue operating aging RCAF VIP aircraft in U.S. airspace

    DAVID PUGLIESE, OTTAWA CITIZEN Two RCAF Challenger aircraft are too old to be upgraded with the modern systems required to meet new regulations for civilian airspace. Canada has cut a deal with the United States to allow two of the military's aging Challenger jets to continue to operate in American airspace despite not having the required new air traffic control equipment on board. The two Royal Canadian Air Force Challenger aircraft, used for VIP transportation and other military duties, are too old to be upgraded with the modern systems required to meet new flight regulations for civilian airspace. The new rules come into effect for the U.S., Mexico, Columbia, Saudi Arabia and the United Arab Emirates on Jan. 1. For most of Europe, those rules will apply starting June 7. In Canada, the rules are being phased in between Jan. 1, 2021, and Jan. 1, 2023. The aviation rules call for increased reliance on data links, new air traffic control surveillance technologies and satellite-based navigation. The regulatory changes are being implemented worldwide and are commonly referred to as ADS-B. Canada had been in ongoing negotiations with the U.S. government and its Federal Aviation Administration (FAA) over the continued use of the Challengers in U.S. airspace. “The RCAF has confirmed with the United States Department of Defense and the FAA that we will continue to operate our aircraft in U.S. airspace under a Memorandum of Understanding,” Department of National Defence spokesman Dan Le Bouthillier said. “This interim measure will allow the RCAF to continue operating its Challenger aircraft in U.S. airspace with established processes and is a reflection of our strong relationship with our American partners.” The memorandum covers a five-year period. “Since two of our Challenger aircraft are not ADS-B compliant, they may still be subject to suboptimal flight routings in parts of the U.S., depending on location, density of air traffic and other factors,” Le Bouthillier added. That could mean, for instance, that the Canadian aircraft might need to be rerouted or take a different flight path if the level of air traffic in an area is high. The RCAF operates four Challenger jets, with the two more modern aircraft already outfitted with the new equipment. The Liberal government has been reluctant to buy new aircraft since it is expected Conservative MPs will try to score political points about planes being purchased for VIPs such as the prime minister before new fighter jets are bought for the RCAF. When the Liberals were in opposition, they criticized the Conservative government's use of VIP aircraft. Some within the RCAF support either replacing the two older Challenger jets or purchasing a new fleet of four aircraft, noting the planes are also used for military missions such as medical transportation of injured personnel. The older Challenger planes are not the only aircraft in the VIP fleet that have faced problems. The RCAF's specialized VIP aircraft used by the prime minister won't be flying until August 2020 because of an accident this fall. On Oct. 19, while being towed into a hangar at 8 Wing Trenton by contracted maintenance personnel, the Polaris aircraft was significantly damaged when it rolled into the back wall of a hangar. Engineering teams from Airbus, the original manufacturer of the aircraft, and General Electric, which made the engines, assessed the damages and have provided an initial repair plan. “We do not have sufficient detail about potential costs, or the attribution of those costs, to provide any detail at this time,” RCAF spokesman Lt.-Col. Steve Neta stated in an earlier email. Neta said the RCAF was confident it could meet travel needs of the prime minister and other VIPs. The RCAF has other aircraft that can be used for VIP transport, including other Polaris planes and as the CC-144 Challenger fleet, depending on the requirements, Neta added. In early December, Prime Minister Justin Trudeau used another Polaris aircraft to fly to a NATO summit in the United Kingdom. After that plane arrived, though, problems were discovered in one engine and the aircraft was deemed temporarily “unserviceable” while it was repaired.     By Terry Pedwell A mandate letter for Canada's new corrections commissioner calls for more engagement with community groups to help prevent re-offending — something prisoner advocacy organizations say the prison system has not been very good at doing. The letter, issued to Correctional Service of Canada (CSC) commissioner Anne Kelly in mid-August but only made public Wednesday, also calls on her to reduce the use of segregation, especially for inmates suffering from mental illness. Two major lawsuits launched since 2015 have challenged how the prison system uses segregation to keep inmates in line, or to prevent them from harming themselves or others. The letter says prisons should explore new, supervised use of computers so inmates are more prepared to enter the workforce once they are released. And it calls on the commissioner to do more to address the needs of Indigenous offenders, including increasing the use of community-run healing lodges. The government said the letter marks the first time a CSC commissioner has received a public mandate. The letter to Kelly from Public Safety Minister Ralph Goodale says the prison system can not take a one-size-fits-all approach to incarceration. “Different groups of offenders — including black Canadians, women, young adults, LGBTQ2 people and aging offenders — have different needs and experiences, which require tailored approaches,” Goodale said in a statement to Kelly, dated Aug. 17. “In particular, more work needs to be done to address the needs of Indigenous Peoples, who are overrepresented in federal custody.” Jennifer Metcalfe, executive director of Vancouver-based Prisoners' Legal Services, applauded the mandate, but said she is frustrated the government has appealed recent court decisions denouncing the use of segregation. “If the government was really committed to making concrete changes that would have a positive impact on peoples' health and mental health, they shouldn't be fighting these issues in the courts,” she said. Her legal services clinic has filed a human rights complaint on behalf of prisoners with mental disabilities that calls for significant changes to Canada's prison system. “We would like to be at the table to help (CSC) come up with alternatives to solitary confinement that would better treat people with mental disabilities,” said Metcalfe. She said more money needs to be invested in mental health care services for offenders, rather than warehousing people where they can develop bad behaviours including self injury. Goodale said the CSC commissioner has four critical responsibilities: ensuring offenders can live law-abiding lives when they are released, providing a safe workplace for prison employees, showing victims of crime compassion and keeping them informed, and ensuring offenders are treated safely and humanely. Prime Minister Justin Trudeau announced the appointment of Kelly as CSC commissioner in late July.
