    Canada’s defence industry positioning for life beyond COVID

    Posted on May 15, 2020 by Chris Thatcher In an appearance before the Commons finance committee on May 12, Parliamentary Budget Officer Yves Giroux suggested the federal deficit could vastly exceed the $252 billion he projected in mid-April as the government continues to unveil relief measures to help Canadians and businesses withstand the economic impact of the coronavirus pandemic. Most admit it is to too early to tell what that will mean for future military procurement and the government's 2017 defence policy, Strong, Secure, Engaged (SSE), but think tanks and defence analysts are nonetheless forecasting turbulence ahead. “Over the past generation, recessions and the fiscal consolidation that has followed them have had a seriously negative impact on DND's (Department of National Defence) budget,” wrote Eugene Lang, an adjunct professor with the School of Policy Studies at Queen's University and Fellow with the Canadian Global Affairs Institute, in a recent policy paper for CGAI. “The future for SSE and its associated funding does not look bright. National defence probably has a year or two before the crunch hits.” Christyn Cianfarani is more cautious, but the president and chief executive officer of the Canadian Association of Defence and Security Industries (CADSI) admits the “rumblings are there that we are naturally concerned. Anybody who knows their history will tell you that when federal governments have been in these deficit spending situations — and this is the largest since the Second World War — they typically will be looking for strategies to reduce that deficit in the long term and DND unfortunately is a target.” But pulling government funding from a sector that has weathered the COVID-19 storm reasonably well might be “counterintuitive,” she suggested. The sector “right now is one of the few that is able to contribute to the economy under this persistent pandemic environment ... If there are multiple waves of [the virus], defence will be one sector that actually can shoulder the ups and downs and return to remote operations if we get to that stage again.” “Pure play” defence companies with few or no ties to commercial aerospace and the travel industry have managed the risks well, she said. Most have so far avoided the workforce layoffs and temporary downsizing experienced in other sectors, though manufacturing has slowed to meet provincial health regulations. Some, in fact, have been hiring. “Aside from some localized instances of companies facing real challenges, I would say the overall health [of the sector] is not too bad,” she said. Following what she called a “choppy” roll out of COVID-19 related policies that cut across federal and provincial jurisdictions, defence companies have adapted. Some have retooled shop floors and supply chains to manufacture critically needed personal protective equipment (PPE). Others with government contracts have continued operations where possible, albeit at reduced levels to match restrictions at government facilities. Maintenance on some platforms such as submarines has halted. The federal government has been “very conscious of trying to keep the contracts moving and executing,” said Cianfarani. “For example, if you are in the Canadian shipbuilding program, you are still pushing forward. If you are part of that supply chain, that hasn't seen any tangible change in the expectations.” Furthermore, many smaller defence firms specialize in software development and cyber security, both of which remain in demand as governments and companies try to protect expanded networks that now include thousands of employees working from home. The greatest concern for members has been liquidity, she said. CADSI encouraged the Business Development Bank of Canada and Export Development Canada to set aside their traditional risk aversion to the defence sector as they work with private sector lenders to support access to capital. The Business Credit Availability Program includes loans of up to $60 million and guarantees of up to $80 million. “We are quite proud of making a big intervention on that,” she said. “It was supposed to be open for all businesses and, irrespective of ... whether you characterize certain businesses as higher risk than others, it is an incentive program at the federal level.” An essential service At the outset of the COVID-19 economic slowdown, CADSI was a vocal advocate for defence as an essential service and greater harmonization of federal and provincial policies, including the rules that allow embedded contractors to access Canadian Armed Forces facilities. As provincial governments now begin easing restrictions and take the first tentative steps to open their economies, the association is calling for guidance and common standards, especially for the use of protective masks, gloves and other clothing. Of particular concern are the rules for employees of companies that embed on Wings and Bases to provide training, platform maintenance, healthcare and other services. “Who has to wear protective health equipment in a DND facility and is it the same [federal standard] across different provincial jurisdictions?” said Cianfarani. “If Ontario decides you have to stand two metres apart and Nova Scotia doesn't have the same policy,” it will create confusion. “If you need a particular face mask to go onto a DND base to perform maintenance on their aircraft, what does that look like? If it is so specialized, can you help us procure it? Or, if it is not so specialized, can you give us a specification so we can ensure that we do have it when we get spooled up to work?” Likewise, what PPE do companies need to provide when DND and other government employees visit their facilities? DND has released some information on “what they are starting to classify as health equipment versus PPE,” she said. “If companies have that information, they won't get to a DND facility and be surprised by a piece of PPE they need or a standard of working they need to accommodate.” Made in Canada The economic repercussions of the pandemic likely won't be felt in the defence sector for some time. Cianfarani noted that some companies have found opportunity in the crisis and will increase investments in automation, big data and other elements of Industry 4.0 as they position for the future. “This is probably an acceleration of something that has been going on slowly in the background for quite sometime,” she observed. But the pandemic has opened the door to a renewed discussion about a national defence industrial strategy, an issue CADSI has been flagging for over a decade. Buying made-in-Canada defence and security platforms and systems is more expensive, but the past months have demonstrated that protectionism is “alive and well.” President Donald Trump in early April asked U.S.-based 3M to stop supply N95 masks to Canada. “The crisis has certainly given us and the government, and Canadians in general, a renewed interest in the concept of having sovereign capability,” she said. Shifting to a procurement culture that accepts the risks and costs of Canadian-built equipment won't happen quickly or easily — it took about seven years to study and adopt recommendations for Canadian key industrial capabilities, she noted — “but I really do think if there is any opportunity, it is probably now, because the shock is still very prevalent in everyone's mind.” https://www.skiesmag.com/news/canada-defence-industry-covid

    SNC-Lavalin's legal woes are putting a $500M federal defence contract at risk

    Murray Brewster · CBC News A SNC-Lavalin contract with the Department of National Defence (DND) worth half a billion dollars comes up for renewal next year — when the Montreal-based engineering giant is expected to be on trial over corruption charges. The pending expiry of the $507 million contract to support the servicing of minor warships and auxiliary vessels, signed in 2011, sharpens the debate over what a guilty verdict would mean for the Quebec-based engineering giant and whether a conviction actually would mean subjecting the company to a 10-year ban on bidding for federal contracts. The stakes are high for DND. In addition to holding an important defence contract, SNC-Lavalin has access to a range of secret military drawings, equipment and intellectual property. Although its agreements are periodically reopened to new bids, the embattled corporation has been a reliable contractor for National Defence. A survey of active federal government contracts shows DND and Public Services and Procurement Canada (PSPC) were the two biggest users of SNC-Lavalin services and construction during the current fiscal year. Across the whole of the federal government, SNC-Lavalin holds 53 'active' federal government contracts — 25 of them with DND — with a combined value of $670 million. A company with a big federal footprint The firm signed roughly $68 million in new or renewed agreements with the federal government ($23.7 million with DND and PSPC alone) in the current budget year up to the end of December. That figure excludes what could be a large number of smaller contracts worth less than $25,000 — contracts the federal government can award without competition. An inventory of those agreements is extremely difficult to track down, but PSPC acknowledged it awarded $146,522 in minor work to SNC-Lavalin in the current fiscal year. The RCMP laid corruption charges against SNC-Lavalin and some of its units in February 2015. All the charges relate to the company's operations in Libya. The charges allege that the company offered officials in that country $47 million in bribes and accuse SNC-Lavalin and two of its subsidiaries of defrauding various Libyan public agencies of approximately $129.8 million over 10 years, starting in 2001. The company has been at the centre of a political firestorm since early February, when The Globe and Mail reported that former justice minister Jody Wilson-Raybould felt pressured by the Prime Minister's Office to grant the company a deferred prosecution agreement (DPA) — a legal tool which would have allowed the company to avoid a criminal trial by acknowledging fault and paying a fine, among other conditions. In defending their interest in a DPA for SNC-Lavalin, Prime Minister Justin Trudeau and others in his government have pointed to the scale of the engineering firm's business, the possibility it could be banned from federal government work and the number of people it employs. Scott Newark, a former Crown prosecutor who teaches at Simon Fraser University, said it's been clear from the outset that avoiding the federal contract ban has been SNC-Lavalin's main objective. The question of what would happen to those federal contracts should the company be convicted is a subject of debate, however. There are policy provisions that allow federal officials to cancel existing contracts and ban future bids from a company convicted of serious crimes, such as bribery. PSPC would only say the federal government would "assess the situation" if "a supplier becomes ineligible during the life of a contract" due to a conviction. The power to terminate or suspend a contract rests with federal bureaucrats, according to PSPC's Ineligibility and Suspension Policy. A company convicted of serious crimes can avoid being fired by the feds by signing an undertaking stating "that it will conduct business with Canada in an ethical and responsible manner." But there's never a guarantee that such an undertaking will be offered to a convicted company. Just three companies are currently banned from carrying on business with the federal government — all relatively small firms in Ontario, Quebec and Newfoundland. No ban on bidding during trial A spokesman for DND said there's nothing stopping SNC-Lavalin from continuing to bid on federal contracts as they appear, even during its trial. "These contracts were issued pursuant to Government of Canada contracting regulations, particularly as it concerns open, fair and transparent competitions," said Dan Le Bouthillier in an email. "Those regulations also stipulate that any company eligible to bid on Government of Canada contracts may continue to do so, so long as they meet the necessary requirements for the work." In an analysis piece for the Macdonald-Laurier Institute, Newark said PSPC is working on a revision of its 'integrity regime' policy to give federal officials more discretion to waive bans of individual companies contracting with the federal government. Public Services Minister Carla Qualtrough has said her department is looking at eliminating fixed bidding disqualification periods and replacing them with a wholly discretionary determination — which would include the option of imposing no contracting ban at all. Even under the current system, Newark said, an order cancelling a company's federal contracts and banning it from future contracts following a conviction is far from a slam-dunk. "I checked on the Criminal Code and the Corruption of Public Foreign Officials Act and, of course, it's not in those statutes. It's not a mandatory consequence." he said. The integrity regime review has been underway in Qualtrough's department since 2017. Newark said he's amazed that nobody with the company or the federal government seems to have realized that a conviction for SNC-Lavalin could lead to something other than a 10-year contracting ban. "Why didn't anybody say, 'Hey wait a minute. We know what about this. We're changing our policy,'" he said. The head of procurement at DND attempted to reassure members of the all-party House of Commons defence committee during a hearing last month that SNC-Lavalin's "secret" work for the federal government does not pose an unacceptable risk. "We hold the intellectual property, the drawings and everything," Pat Finn testified on Feb. 28.     Routine operations and patrols within Canada will continue The Canadian military has banned all foreign travel and ordered non-essential personnel to stay home — part of its sweeping response to the global outbreak of COVID-19. A formal order — known as a CANFORGEN — was issued Friday after a preliminary warning order was issued to units across the country the day before. In an interview, the country's top military commander also said a handful of troops who recently returned from an overseas operation have voluntarily gone into self-isolation at the military airbase in Bagotville, Que., but they are not considered "presumptive cases." Chief of Defence Staff Gen. Jonathan Vance confirmed that only one member of the military — a naval reservist — is in hospital in Spain after being formally diagnosed with the illness. 'Miltary operations will continue' He said those returning from deployment and leave outside of Canada will be ordered to self-isolate. "We're trying, at this point in time, to pause all things, but necessary military operations will continue," Vance said. The new travel ban will mean that the few thousand troops now serving on deployments, exercises and exchange positions will not be allowed to leave the countries where they are operating. Reservists, who serve part-time, are being encouraged to abstain from personal travel outside of Canada. Bases will be closed to visitors, including foreign delegations. Military training schools will restrict new entrants and those already on course will be confined to base. "While at home, or on leave, in Canada, I'm asking members to adopt an approach that protects themselves and their family from the virus," Vance said. "I expect our command and control headquarters to continue operations, albeit at reduced levels, and some units will be able to stand down to essential administration and command functions only." Dave Devenney, a spokesman for the defence chief. "Our job is to stay healthy, preserve the force and be prepared to fight." Dave Perry, a defence analyst at the Canadian Global Affairs Institute, said the orders are meant not only to halt the spread of the virus but to give the military flexibility to respond if the civilian health care system or vital infrastructure becomes overwhelmed. "The military is pre-positioning if they are called out to help the government in any significant way," he said. Troops could be deployed with transport and communications to help frontline health workers, such as the people doing virus screening. "People at the frontline of the pandemic could require a host of supports," Perry said. An order for federal government workers to stay home also could put a strain on some parts of the country's telecommunications grid. "The military has independent communications that can work around that securely," Perry added. The order follows on a series of measures the military has taken in response to the unfolding pandemic crisis. At that time, Vance said federal officials, under a worst-case scenario, were prepared for an absentee rate among government workers of 25 per cent and that the military is looking at a similar number. He added that the best defence is to not get sick at all. The biggest issue the Department of National Defence has faced thus far has been the civilian travel restrictions, which have hampered the movement of personnel. It also has prevented the full resumption of the military training mission in Iraq, a senior commander told a parliamentary committee this week. There is concern for the forces operating in war zones like Iraq, where the health care system lies in ruins. As of Thursday, Iraq reported 74 confirmed cases of COVID-19 and eight fatalities. Approximately one-quarter of the country's cases are known to be in the northern Kurdistan region, where Canadian special forces troops have been conducting an advise-and-assist mission to help root out the remaining extremist holdouts after the fall of the Islamic State. The country's second-largest city, Mosul, was largely destroyed by the fighting.
