    Federal contractors face great uncertainty as coronavirus spreads

    Andrew Eversden To stop the spread of the new coronavirus, federal agencies could shutter facilities. States and localities are already issuing shelter-in-place orders. And with obscure rules surrounding telework for federal contractors as well as the potential for supply chain disruptions and employee infections, there could be a new level of unpredictability for the contractor community. “There's both a little bit of stability and a fair amount of uncertainty,” said Alan Chvotkin, executive vice president and counsel at the Professional Services Council, an interest group representing more than 400 government contractors. “Things that were normal yesterday are not normal today. Behaviors that were planned for over the last couple days have been changed as government missions are changing,” he added. In the near term, schedules laid out in contracts will likely experience delays and costs may increase due to disruptions caused by COVID-19, said Jonathan Aronie, head of law firm Sheppard Mullin's government contracts practice group. These disruptions could be caused by employees not coming into work, or their suppliers' employees not working. President Donald Trump said March 18 that he's willing to use the Defense Production Act to force companies to manufacture goods the government needs to fight the virus, like ventilators or masks. These orders become “rated,” essentially allowing the government to skip to the front of the line. That poses other challenges. “While some companies are going to have problems that are slowing them down, other companies are going to have the problems associated with an influx of new orders,” Aronie said. Aronie warned of a complex web of orders that companies could have to fulfill, pulling businesses in different directions. For example, he said, companies could get an order from a hospital, an order from a state government with a preexisting contract, and then a rated order from the federal government as well as agencies without rated authorities — potentially overwhelming and confusing manufacturers. “Somehow you're going to have to make sense of this all,” Aronie said. Effects of telework Across the government, federal employees eligible for telework have generally been allowed to do so. But contractors haven't always followed the same rules. Not allowing contractors to telework could have significant ramifications, experts warned. Many contractors are required by their contracts to work in government facilities. But to stop the spread of COVID-19, access to these facilities could be limited or completely shut off. This conundrum leaves contractors with questions for the government. “Are there going to be access issues? Are contractors going to be asked in some cases to work from home where previously they were going into a government facility? What does that mean from a performance perspective? What does that mean from a cost perspective? How do you work that out with the government?” said Roger Waldron, president of the Coalition for Government Procurement. “These are some of the thing people are thinking about.” On March 20, the Office of Management and Budget's deputy director for management, Margaret Weichert, released a memo urging agencies to “maximize telework for contractor employees.” But, as reported by Federal News Network, Weichert's memo did not mandate telework for federal contractors, leaving industry frustrated. Several interest groups that represent government contractors called on congressional leaders and the White House to allow contractors to work from home. PSC wrote a letter to OMB on March 18 warning that not issuing guidance regarding extending telework flexibility to contractors could lead to layoffs. “The duration of this is a huge uncertainty, if it does get worse before it gets better, if folks are really unable to perform the kind of work that need to be done at some government locations, that'll have some impact on people,” Chvotkin told Federal Times. Over the last few days, several states such as California and New York have begun following shutdown orders that could leave contractors in tenuous positions. A Justice Department memo from March 20 also directed U.S. attorneys general to tell state and local officials that federal employees must be allowed to travel and commute, “even when travel restrictions are in place.” This action didn't mention contractors either. State governments are going to have to “recognize that exceptions are going to be essential and some federal missions are just going to be so important to continue on that they'll have to accommodate them,” Chvotkin said. How does this compare to the government shutdown? This is the second consecutive year that contractors have faced challenges due to a crisis; last year's was the record 35-day government shutdown. Some aspects of the 2019 shutdown and the coronavirus crisis are the same. For example, Aronie said, both increase delays and incur higher costs on contractors. The big difference is that some companies will receive more work, instead of less. Another significant difference is that employees, both from the federal government and contractors, are still working — many federal employees from home. This increase in telework has increased agencies' demands for IT infrastructure as they work to accommodate the rise in telework. Last week, the White House requested several billion dollars for agencies to improve their IT infrastructure. Under the COVID-19 pandemic, the uncertainty is greater than during a government shutdown, experts said, because the ending was solely in the hands of the government. “Even in the shutdown ... everybody recognized that it was going to end sooner or later.     Defense budget brawl looms after pandemic

    BY REBECCA KHEEL - 05/03/20 01:30 PM EDT Defense budget cuts are looming as the coronavirus pandemic places pressure on the federal budget across various agencies. The Pentagon had already been expecting relatively flat budgets for the next few years due to economic constraints caused by the widening deficits in the country. But with the pandemic, the deficit is projected to explode after Congress passed trillions of dollars in coronavirus relief packages, with more aid bills expected. Defense budget analysts are predicting that will mean cuts to defense spending down the line. Meanwhile, Democrats say the crisis should result in a rethinking of national security that gives less money to the Pentagon and more to areas like public health. The chairman of the House Armed Services Committee said this past week it's hard to predict where the defense budget will head after the crisis abates, but suggested the entire federal budget will need to be re-examined. “The economics of this get much more complicated than they were before this, and it's logical to assume that we are going to have to reevaluate our entire budget, both revenue and expenditures,” Chairman Adam Smith (D-Wash.) said on a teleconference in response to a question from The Hill. “Beyond that, it would be pure speculation as to what's gonna happen.” Smith, a long time opponent of the nuclear budget, specifically highlighted nuclear modernization as an area for potential cuts, but said defense portfolios are “all on the table to figure out how to spend the money more wisely.” In the meantime, defense hawks, progressives and deficit hawks alike are honing their arguments as they brace for defense cuts. The defense budget battles are already starting to play out as Congress debates further coronavirus relief bills. The Pentagon has said it expects to request “billions” of dollars in the next bill to help contractors hit by the virus. That funding would follow the $10.5 billion the Pentagon got in the third coronavirus stimulus package for the Defense Production Act, defense health programs, and military deployments related to the crisis and other areas. Smith, though, said this past week he would not support more Pentagon funding in further coronavirus bills, saying the department can find unused funding in its existing $738 billion-plus budget. Smith's comments came about a week after dozens of progressive organizations led by Win Without War argued in a letter to Congress that “any arguments that the Pentagon cannot use existing resources to respond to the crisis should be met with considerable skepticism.” But the Pentagon maintained after Smith's comments it cannot dip into its existing budget for coronavirus relief. Ellen Lord, the Pentagon's top weapons buyer, said the department may be able to use some operations and maintenance funds for coronavirus needs, but added money still has to be available for “pretty significant needs” in readiness and modernization. “I am not sure that we have the fiscal flexibility to encompass all of the new demands we have and the inefficiencies that we are seeing and perhaps may see in the future,” Lord said at a briefing. “But I respect what Chairman Smith is saying, and we will obviously do our best.” Looking further ahead, Pentagon officials have indicated they are preparing to tighten their belts at the other end of the crisis. In a webinar with the Brookings Institution this past week, Army Secretary Ryan McCarthy recalled “compressed budgets” in the wake of recovery bills for the 2008 financial crisis, culminating in the 2011 Budget Control Act that Pentagon officials now blame for readiness shortfalls. The law set budget caps that resulted in sequestration, continuing resolutions or government shutdowns in several years. “These are challenges we're thinking about now as we look at the [Future Years Defense Program] and whether or not this will pressurize Army budgets in the [fiscal year] 23, 24 timeframe, which are very critical to us and our modernization efforts and increasing our talent management within the force," he said. “We are watching that very closely, and we know that is a challenge that is out in front of us.” Late last month, the Congressional Budget Office projected that Congress' rescue and stimulus efforts will cause the federal deficit to quadruple to $3.7 trillion, the largest by far in U.S. history. Defense budget experts say the ballooning deficit likely spells defense cuts in the future, citing trends after previous rising deficits and economic downturns such after the 2008 financial crisis. “What has historically happened is, when Congress and fiscal conservatives come out and get serious about reducing the debt and reducing spending, defense is almost always part of what they come up with for a solution,” Todd Harrison, director of defense budget analysis at the Center for Strategic and International Studies, said in a webinar. “So, we could be looking at a deficit-driven defense drawdown coming in the next two or three years. At least history would suggest that that is a real possibility.” In the same webinar, American Enterprise Institute resident fellow Mackenzie Eaglen predicted the “budget comes down sooner rather than later.” “There probably will be a total relook even at the [National Defense Strategy] fundamentals and what mission is going to have to go in response to this,” she added. But defense hawks are arguing the Pentagon should not be used to pay other bills,, saying the country still faces threats from Russia and China. Fred Bartels, a senior policy analyst for defense budgeting at the conservative Heritage Foundation, said the defense budget needs to match the National Defense Strategy, which has not changed despite the pandemic. The strategy calls for the military to be ready for so-called great power competition with China and Russia. “What you're going to have is likely empty promises, and that's the worst possible outcome for the military,” Bartels said of a budget cut without a strategy change. “If your national strategy tells the world that you're going to do that but you don't follow through, it's going to be harder and harder to operate.” But the pandemic has intensified calls from progressive lawmakers to rethink what constitutes national security. Rep. Ro Khanna (D-Calif.) told The Hill the crisis shows the definition of national security needs be expanded. “Lawmakers must view issues like climate change, biosecurity, cybersecurity and this pandemic as serious and real national security threats facing our nation,” Khanna said in a statement to The Hill. “For too long, we were myopically focused and spending trillions on traditional national security issues like terrorism and ‘great power' politics. Il s'agit d'un projet développé par BAE Systems, une société britannique œuvrant dans les secteurs de la défense et de l'aérospatial. Selon un communiquépublié le 21 septembre 2018, il est question d'un tableau de bord vierge, sur lequel sera projetée l'intégralité des informations de vol depuis le casque du pilote, une sorte de cockpit portable (wearable cockpit). Le but est ici de permettre au pilote de ne plus l'cher le manche des mains en cours de vol, et d'éviter à ce dernier de se perdre dans une multitude d'informations. Le tableau de bord virtuel est équipé d'une intelligence artificielle et d'un système de détection du regard. Il est destiné à être reconfigurable à souhait, adaptable au contexte du moment, mais également évolutif (voir schéma ci-dessous). «Le point le plus important sera de déterminer l'objectif du pilote, et d'utiliser des systèmes intelligents pour assurer la performance des t'ches et réduire la charge de travail du pilote. Nous voulons faire cela de manière à ne pas toujours demander la permission, car cela deviendrait rapidement très pénible, mais il est essentiel que le pilote sache clairement quelle est la t'che exécutée par le système intelligent », a déclaré Jean Page, responsable technique du projet. Il s'agit ici clairement de vaincre ce que l'on appelle la tunnélisation de l'attention(ou tunnélisation attentionnelle). C'est le fait que le pilote se focalise à 100 % sur un éventuel problème en cours de vol, ignorant les alertes des paramètres de vol. Cela peut même aller jusqu'aux manœuvres de pilotage les plus élémentaires, qui conduisent à la perte de contrôle puis à l'accident. Selon BAE Systems, ce nouveau dispositif actuellement en développement est destiné à équiper le futur avion de chasse Eurofighter Tempest, qui vise à remplacer l'Eurofighter Typhoon dès 2025. Il s'agit d'un avion développé par le consortium Eurofighter GmbH (Royaume-Uni, Italie, Allemagne et Espagne).
