    Federal contractors face great uncertainty as coronavirus spreads

    Andrew Eversden To stop the spread of the new coronavirus, federal agencies could shutter facilities. States and localities are already issuing shelter-in-place orders. And with obscure rules surrounding telework for federal contractors as well as the potential for supply chain disruptions and employee infections, there could be a new level of unpredictability for the contractor community. “There's both a little bit of stability and a fair amount of uncertainty,” said Alan Chvotkin, executive vice president and counsel at the Professional Services Council, an interest group representing more than 400 government contractors. “Things that were normal yesterday are not normal today. Behaviors that were planned for over the last couple days have been changed as government missions are changing,” he added. In the near term, schedules laid out in contracts will likely experience delays and costs may increase due to disruptions caused by COVID-19, said Jonathan Aronie, head of law firm Sheppard Mullin's government contracts practice group. These disruptions could be caused by employees not coming into work, or their suppliers' employees not working. President Donald Trump said March 18 that he's willing to use the Defense Production Act to force companies to manufacture goods the government needs to fight the virus, like ventilators or masks. These orders become “rated,” essentially allowing the government to skip to the front of the line. That poses other challenges. “While some companies are going to have problems that are slowing them down, other companies are going to have the problems associated with an influx of new orders,” Aronie said. Aronie warned of a complex web of orders that companies could have to fulfill, pulling businesses in different directions. For example, he said, companies could get an order from a hospital, an order from a state government with a preexisting contract, and then a rated order from the federal government as well as agencies without rated authorities — potentially overwhelming and confusing manufacturers. “Somehow you're going to have to make sense of this all,” Aronie said. Effects of telework Across the government, federal employees eligible for telework have generally been allowed to do so. But contractors haven't always followed the same rules. Not allowing contractors to telework could have significant ramifications, experts warned. Many contractors are required by their contracts to work in government facilities. But to stop the spread of COVID-19, access to these facilities could be limited or completely shut off. This conundrum leaves contractors with questions for the government. “Are there going to be access issues? Are contractors going to be asked in some cases to work from home where previously they were going into a government facility? What does that mean from a performance perspective? What does that mean from a cost perspective? How do you work that out with the government?” said Roger Waldron, president of the Coalition for Government Procurement. “These are some of the thing people are thinking about.” On March 20, the Office of Management and Budget's deputy director for management, Margaret Weichert, released a memo urging agencies to “maximize telework for contractor employees.” But, as reported by Federal News Network, Weichert's memo did not mandate telework for federal contractors, leaving industry frustrated. Several interest groups that represent government contractors called on congressional leaders and the White House to allow contractors to work from home. PSC wrote a letter to OMB on March 18 warning that not issuing guidance regarding extending telework flexibility to contractors could lead to layoffs. “The duration of this is a huge uncertainty, if it does get worse before it gets better, if folks are really unable to perform the kind of work that need to be done at some government locations, that'll have some impact on people,” Chvotkin told Federal Times. Over the last few days, several states such as California and New York have begun following shutdown orders that could leave contractors in tenuous positions. A Justice Department memo from March 20 also directed U.S. attorneys general to tell state and local officials that federal employees must be allowed to travel and commute, “even when travel restrictions are in place.” This action didn't mention contractors either. State governments are going to have to “recognize that exceptions are going to be essential and some federal missions are just going to be so important to continue on that they'll have to accommodate them,” Chvotkin said. How does this compare to the government shutdown? This is the second consecutive year that contractors have faced challenges due to a crisis; last year's was the record 35-day government shutdown. Some aspects of the 2019 shutdown and the coronavirus crisis are the same. For example, Aronie said, both increase delays and incur higher costs on contractors. The big difference is that some companies will receive more work, instead of less. Another significant difference is that employees, both from the federal government and contractors, are still working — many federal employees from home. This increase in telework has increased agencies' demands for IT infrastructure as they work to accommodate the rise in telework. Last week, the White House requested several billion dollars for agencies to improve their IT infrastructure. Under the COVID-19 pandemic, the uncertainty is greater than during a government shutdown, experts said, because the ending was solely in the hands of the government. “Even in the shutdown ... everybody recognized that it was going to end sooner or later. Multirotor drones excel at vertical lift and hover, while fixed wing drones are great at both distance and wide-open spaces. In February, Auterion announced a two-pronged approach to the rotor- or fixed-wing drone market, with a pair of drones that use the same sensor packages and fuselage to operate as either the Scorpion Trirotor or the Vector fixed wing craft. “As we started to develop our tactical UAS Platform, our plan was only to develop a VTOL fixed wing solution (like our Vector),” said Dave Sharpin, CEO of Auterion Government Solutions. “During the development process we decided to build a Tri-Copter Platform as well, as a result of many discussions with law enforcement agencies and Search and Rescue Units.” Adapting the fixed-wing fuselage to the tri-copter attachments means the drone can now operate in narrow spaces and harsh conditions. Scorpion, with the rotors, can fly for about 45 minutes, with a cruising speed of zero to 33 mph. Put the fixed wings back on for Vector, and the flight time is now two hours, with a cruising speed of 33 to 44 mph. The parts snap into place without any need for special tooling, and Auterion recommends the drone for missions in rain or snow. Both platforms share a gimbal EO/IR with 10x optical zoom, 720p EO video, 480p IR video, laser illuminator, IR laser ranger. Common between modes is also a tactical mapping tool using a 21 megapixel Sony UMC R10C camera. For the scorpion, there's also the option of a gimbaled electro-optical camera with a 30x optical zoom. Both drones are designed to fit in rucksacks that a person can carry one at a time. While many features are common across Vector and Scorpion, the plan is not to include both rotors or wings in the same kit. Once a team packs into the field with a drone on its back, that's the mode the drone can be used in. Auterion intends to ship the drones by the fourth quarter of 2020, with preorders available. Designing a drone body is about settling on the right compromise. Vectr and Scorpion are built on top of open source code. This includes an operating system capable of programmable autopilot , as well as machine-vision collision prevention and obstacle detection and avoidance. Software for the ground station and cloud data management of the drone are also built on open source code. The Pentagon's Defense Innovation Unit awarded the company a $2 million contract last year to work on the PX4 software to help drive compatibility standards in the drone industry. As militaries across the world look to the enterprise sector for capable drones at smaller profile than existing military models, transparency in code and flexibility in airframe could become more widely adopted trends.     Remington Arms has offered to donate manufacturing space for hospital supplies in New York. CEO of the gun manufacturer, Ken D'Arcy, wrote a letter Monday, March 23, to Governor Andrew Cuomo and President Donald Trump offering "approximately one million square feet of unused and available manufacturing space" at the Ilion plant, the Ithaca Journal reported. Cuomo issued an executive order for all nonessential workers to remain home, and the company announced Friday it would shut down in compliance until April 30. D'Arcy said the company would be honored to help produce ventilators, surgical masks, hospital beds or any other products to aid the efforts to combat the coronavirus. Cuomo said Tuesday that the state has 7,000 ventilators and needs 30,000 for an anticipated surge of patients. Remington Arms has joined several other companies to offer to help fight back against the coronavirus pandemic. Several distilleries have started producing hand sanitizer to help fill the shortage. New York has more than 30,000 confirmed cases and 285 deaths. The nation-high figures are driven mostly by New York City.     NGen Announces Funding Program to Scale COVID Response

    Dear NGen Member, Today, NGen announced that it will invest $50 million in Supercluster funding to support companies as they rapidly respond to the COVID-19 pandemic by building a Canadian supply of essential equipment, products, and therapeutics. Projects will be selected for funding according to critical needs identified by the Government of Canada and the ability of manufacturers to produce products that are safe for both patients and health care workers. NGen will prioritize funding for projects that can have an immediate impact between April and the end of June 2020 and will fund eligible costs for projects within this timeframe up to 100% (depending on the level of knowledge and information sharing to help Canadians). Projects that will have an impact in the medium term – beyond the June 30 timeframe may also be considered for funding at 50%. Projects are not expected to exceed funding of more than $5m.     Mid-Project Status Report published: Leonardo led “Canadian Weather Radar Replacement Project” fully on schedule

    Rome, March 23, 2020 - Leonardo, through its German subsidiary Leonardo Germany GmbH, is proud to inform on the successful results of the official “Mid-Project Status Report” for the “Canadian Weather Radar Replacement Project” published by Environment and Climate Change Canada (ECCC). The “Mid-Project Status Report” is established and updated on a yearly basis and summarizes the verification of the conformity between project execution and scheduled targets by the end of each year under review. The “Canadian Weather Radar Replacement Project”, which was awarded to Leonardo in 2016, comprises the design, manufacture, supply, installation, commissioning and training, as well as maintenance and technical support during the warranty phase, for twenty Klystron S-Band weather radars – plus thirteen additional radars in options - including infrastructure for existing and new radar sites running from Holyrood on the East Coast to Vancouver Island on the West Coast of Canada. Seven of the thirteen weather radars originally in options have meanwhile been placed as orders by ECCC. According to the “Mid-Project Status Report” recently published, project execution is fully in line with the scheduled time and cost frames. Twelve weather radars including infrastructure and agreed accessories were delivered. All radars were installed and put into operation precisely according to plan. Additional requirements for safety and increase in performance that had been set by ECCC during the design phase, were successfully implemented by Leonardo. Training and documentation were delivered, and maintenance works performed as scheduled. The cost-management proceeded within the frame of the agreed budget. Prior to the report, Leonardo's performance had been objectively assessed and evaluated according to ECCC's vendor performance evaluation system. The evaluation was conducted by the CWRRP/ECCC team in conjunction with PSPC Contracting Authority, including criteria Quality of Workmanship, Time, Project Management and Health and Safety. In the overall rating, Leonardo achieved a score of 83 of 100 possible points and with this result, one of the highest scores ever awarded in any Public Works and Government Services Canada contract up to now. The pleasantly positive overall results stated at Mid-Project term underpin Leonardo's strengths and excellence in contract execution even in most challenging weather radar projects. The “Canadian Weather Radar Replacement Project” is one of the largest and – especially in terms of technological complexity, infrastructure and environmental requirements - most demanding projects ever awarded to the weather radar industry. Canada is a key market for Leonardo, with interests and opportunities spanning from helicopters to airport solutions such as parcel handling systems and air traffic control systems.     Leonardo DRS receives contract for Army mortar Fire Control Computers

    Arlington, VA, March 23, 2020 ̶ Leonardo DRS, Inc. announced today that it has been awarded a contract by Elbit Systems of America to provide advanced rugged tablets as the Fire Control Computer Two (FCCII) for U.S. Army Mortar Fire Control Systems. The $20.6 million contract, was awarded in October 2019. The FCCII hosts the software which enables the warfighter to interact with the overall system designed to reduce the time it takes soldiers to prepare and fire rounds. The FCCII is a rugged computer tablet from the Leonardo DRS Land Electronics business. When loaded with Mortar Fire Control software, it is capable of computing firing solutions for 120mm mounted and dismounted mortar systems, processing digital call for fires messages from battlefield's Fire Support Network, and providing technical manual reference to the user.     KBR Fortifies Cybersecurity of U.S. Air Force Weapons Systems

    Houston – March 23, 2020 – KBR (NYSE: KBR) announced today that it has been awarded a $26.8 million task order to provide additional cybersecurity engineering support to the U.S. Air Force Life Cycle Management Center (AFLCMC) Engineering Directorate Cyber Systems Engineering Division.
