    Trade tribunal rejects rival's bid to block warship contract

    Murray Brewster · CBC News The Canadian International Trade Tribunal has dismissed a complaint by one of the companies that was competing for the job of designing and helping to build the navy's next generation of warships. Alion Science and Technology Corp. and its subsidiary, Alion Canada, filed the complaint in November and asked that the signing of the contract with the preferred bidder be postponed until the matter could be heard. The trade tribunal, in a decision rendered late Thursday, said the company did not "have standing to file a complaint" before the agency. Last fall, the Liberal government announced plans to award the design contract to a group of companies led by Lockheed Martin Canada and opened negotiations with the intention of completing a full contract this winter. Alion, Lockheed Martin Canada and the Spanish company Navantia were all in the running for the Canadian Surface Combatant project, which will be built at Irving Shipbuilding in Halifax. The federal government issued a statement Friday and indicated progress towards a final contract was ongoing. "Public Services and Procurement Canada is pleased with the CITT's ruling," said department spokesman Pierre-Alain Bujold. "We have full confidence in our process, and continue to work toward awarding a contract for the design and design team for the future Canadian Surface Combatants." Alion had pitched its De Zeven Provinciën Air Defence and Command (LCF) frigate, a Dutch-designed warship, for the Canadian competition and has pointed out that the warship is already in service in other countries.     By: David Pugliese VICTORIA, British Columbia — Canada expects to accept formal bids for a new fighter jet in May, with the first aircraft delivered by 2025, according to Canadian government procurement officials. A draft bid package for 88 fighters was issued to companies for their feedback by the end of this year, said Pat Finn, assistant deputy minister for materiel at the Department of National Defence. From there, the final bidding instructions for the CA$16 billion (U.S. $12 billion) procurement will be issued and bids required by May 2019, he added. The aircraft will replace Canada's current fleet of CF-18 fighter jets. The aircraft expected to be considered include Lockheed Martin's F-35, the Eurofighter Typhoon, the Dassault Rafale, Saab's Gripen and the Boeing Super Hornet. The Canadian government will require a robust package of guaranteed industrial benefits or offsets from the winning bidder, government officials said. But that could be a problem for the F-35, as Canada is still a partner in that program, which does not guarantee participating-nations contracts. Work on the F-35 program is based on best value and price. Canadian industrial participation in the F-35 program has reached $1 billion, as more than 110 Canadian firms have landed contracts related to the aircraft program. Jeff Waring, director general for industrial benefits policy at the federal Innovation, Science and Economic Development Canada, said the country sees the fighter jet program as a “once-in-a-generation opportunity for the Canadian economy.” But he noted the industrial benefits policy is flexible. “It is a market-driven approach,” he said. “It encourages suppliers to make investments that make sense to them.” The issue of industrial benefits has already been discussed with companies interested in bidding on the project, and those talks will continue as feedback is received on the draft bid package, government officials said. Here are details taken from the PBO report: According to PBO calculations, the Canadian fleet is both slightly older and has experienced more usage than the Australian fleet. The average Canadian F-18 had accrued over 6,000 flying hours by the end of the 2017-2018 fiscal year. These calculations are supported by media reports indicating that by 2014, the CF-18s had accumulated over 5,700 flying hours on average, with over a third of the fleet already having flown over 6,000. Canada's Department of National Defence has stated that the aircraft being purchased from Australia's F-18 fleet are very similar to those currently in operation within the RCAF.
