Canadians won't be allowed to work on portions of new Canadian spy planes because of U.S. security regulations

Canadians won't be allowed to work on parts of the country's new surveillance aircraft because they contain sensitive American-made equipment that can only be handled by U.S. citizens.

Maintenance of the equipment, installed in new planes that will be operated by Canadian special forces, will be off-limits both to Canadian military personnel and Canadian aerospace workers. Instead, the gear or the aircraft will have to be sent to the U.S. for maintenance or U.S. government staff will have to travel to Canada to work on the planes. The equipment is subject to strict U.S. security regulations.

Canadian special forces are to receive three surveillance aircraft from the U.S. government. The planes are expected to arrive in spring 2022. The Beechcraft King Air planes, to be based at CFB Trenton, will be outfitted with sensors and equipment to intercept cellphone and other electronic transmissions, and track individuals and vehicles on the ground. Canadian special forces and, potentially, other federal government departments and the RCMP will use the aircraft for missions overseas and in Canada.

Canada is paying the U.S. government $188 million for the aircraft. The overall value of the project is estimated to be $247 million. The funding includes the acquisition of the aircraft and prime mission equipment from the U.S., and an initial portion of the associated in-service support of the planes. The main contractor is Beechcraft in Wichita, Kan.

The maintenance plan for the sensitive equipment that only Americans can work on has yet to be put in place, but the Canadian military is hoping it won't disrupt aircraft operations too much.

“Arrangements for the maintenance of certain specialized equipment are not yet in-place; therefore, details and costs are not known at this time,” Public Services and Procurement Canada spokeswoman Stéfanie Hamel noted in an email. “However, Canada will ensure the sustainment strategy supports continued operations while maintenance is underway.”

The government has not provided details on what parts of the aircraft are covered by the U.S. security regulations.

Another in-service support contract, for the aircraft themselves and related mechanical equipment, will also be put in place. Canadians will be able to do that work.

A request for proposals from Canadian firms for that work is expected to be issued in January or February. The contract would cover maintenance and support over a 20-year period.

Canadian aerospace firms had originally wanted to provide the aircraft and on-board equipment, and in 2013 a number of companies responded when the federal government initially outlined its need for such planes.

But the Canadian military decided it needed the planes more quickly than they believed Canadian companies could deliver. The military was also concerned there could be delays if the on-board sensor equipment used was subject to U.S. security regulations.

The Canadian companies, however, felt they could meet the military's needs with Canadian-made equipment that wouldn't be covered by U.S. regulations, allowing Canada more flexibility.

But the Canadian government instead opted for the American-made solution, which had also been used by Canadian special forces in Afghanistan. The agreement for the aircraft was finalized on April 26, 2019 with the U.S. government.

Canadian special forces personnel recently trained with similar surveillance aircraft operated by the U.S. In mid-November members of 427 Special Operations Aviation Squadron and the Canadian Special Operations Regiment, both based in Petawawa, conducted an exercise supported by one of the American aircraft. The U.S. plane operated from the Ottawa airport, and flights occurred between Petawawa and Mansfield-et-Pontefract, Que., according to Canadian special forces.

“The intent was to conduct a training and needs assessment to ensure the appropriate personnel are trained and equipped to support the arrival of three Beechcraft King Air 350ER as part of the command's Manned Airborne Intelligence, Surveillance and Reconnaissance project,” Maj. Amber Bineau, spokesperson for Canadian Special Operations Forces Command, said in an email.

    With billions of dollars at stake, all parties promise to fix defence purchases

    Every election, would-be prime ministers promise to cancel bad military purchases or processes, hurry along good ones, fix the mess once and for all OTTAWA — The seemingly endless effort to replace Canada's CF-18s fighter jets passed a tiny milestone Friday: fighter-jet makers participating in the $19-billion competition were required to explain how they planned to make their aircraft compliant with U.S. intelligence systems. For nearly a decade, Canadians have been inundated with talk of fighter jets without Canada ever buying them, an ever-worsening symbol of the failures of Canada's military procurement system. Every election, would-be prime ministers promise to cancel bad purchases or processes, hurry along good ones, fix the mess once and for all. Conservative Leader Andrew Scheer this week promised to “de-politicize” military procurement with new oversight bodies in cabinet and the Privy Council Office while working toward multi-partisan consensus on procurement projects in Parliament. The Liberals promise to establish a new agency called Defence Procurement Canada, which suggests taking the entire function away from the four departments that now share responsibility for buying military kit. The New Democrats and Greens promise, without detail, that they will ensure Canada's military gets the equipment it needs. The origins of what we face today can be traced back to the end of the Cold War when Canada and its allies began to cut defence spending after a decades-long arms race with the Soviet Union. There were concerns about whether or not you're getting the right kind of economic benefits “We deferred purchasing new fighter planes and did the same thing with our frigate fleet,” says David Perry, vice-president of the Canadian Global Affairs Institute and one of Canada's foremost experts on defence spending and procurement. “We just kicked the can down the road on fixed-wing search-and-rescue aircraft. There was a bunch of other projects that fit the same vein.” The military had to use equipment for years longer than it was supposed to and the Department of National Defence lost most of its procurement experts. But in the mid-2000s, the Forces' equipment problems were revealed in Kandahar: the military lacked transport aircraft to resupply its Afghanistan mission, artillery and tanks to support troops on the ground and helicopters to move them around. Ottawa rushed into gear, purchasing transport planes, howitzers, helicopters and tanks in short order — in most cases without competitions. New equipment flooded in but there were some big failures, starting with accusations defence officials rigged the requirements for a new search-and-rescue plane to select a specific U.S. plane. There was also a failed effort to buy new supply ships for the navy and, most explosively, a plan to buy new fighter jets, Lockheed Martin's F-35s, without a competition. In 2012, auditor general Michael Ferguson blasted the Defence Department for failing to communicate the stealth fighter's risks, including escalating costs and schedule delays, to Parliament and decision-makers. Dan Ross, who was the department's head of military procurement at the time, would later say defence officials had all the information and were willing to share it — the Harper government just wouldn't let them. Either way, the public's confidence in the system and the government's ability to manage it were shaken. The F-35 purchase was scrapped. The Tories imposed new constraints to keep costs under control and ensure Canadian industry and communities benefit from defence contracts. “There were concerns about whether or not you're getting the right kind of economic benefits, some significant concerns about whether or not process was being adhered to until you had this system recalibration where you had an injection of additional rules and governance,” Perry says. That recalibration imposed a fundamental tension on the system: the need to get the best equipment possible, with the most benefit to the economy or local industry, at the lowest cost. Every big procurement is partly about the military's needs and partly about national industrial policy — and, that means, partly about politics. Most procurements are still completed with minimal fuss. The problems largely lie with big, once-in-a-lifetime contracts like fighters and warships that are worth billions of dollars and are not only essential for the military to operate, but have the potential to benefit Canadian businesses and communities for years. The ones that involve billions of public dollars. “You're trying to get the best bang for the buck for as little buck as possible,” says Queen's University professor Kim Nossal, who wrote a book entitled “Charlie Foxtrot: Fixing Defence Procurement in Canada” in 2016. “The one comforting thing is that very few countries have got the balance right. All industrial countries, all of our allies, faces these kinds of pressures. They worry about jobs and costs and capability.” Efforts to combine the three competing priorities can lead to bickering among federal departments, lawsuits from companies and politicians sticking their fingers in things. Seconds after saying he would de-politicize the military procurement system this week, Scheer promised to negotiate the purchase of an interim naval supply ship from Quebec's Chantier Davie shipyard, which lobbied the Liberal government for years to ink such a contract without success. Davie is one of Canada's big players in shipbuilding — and it's in much-contested political territory just outside Quebec City. Alan Williams, who was the Defence Department's head of procurement from 1999 to 2005 and now advises companies on procurement matters, compares Scheer's promise on Davie to Justin Trudeau's promise in 2015 not to buy the F-35. That's because while a government can decide to purchase a piece of military equipment, procurement laws — and Canada's international trade obligations — forbid it from choosing or excluding a specific product or supplier except under extreme circumstances. Upon taking office, the Liberals twisted themselves in pretzels to get around the legal implications of their promise. That twisting led to a plan to buy Super Hornets from a competing vendor. When that fell through, four years passed before an actual competition was launched — with the F-35 now one of three planes still in contention.     Government expects to award contract for new fighter jet fleet in 2022 (but admits it could face delays)

    DAVID PUGLIESE, OTTAWA CITIZEN Though the federal government expects to award a contract for a new fleet of fighter jets in 2022, it admits that schedule is aggressive and could yet face further delays. A request for bids to provide 88 new jets to the Royal Canadian Air Force will be released next month, according to a new update on major Department of National Defence projects released Wednesday, with the proposals to be evaluated by 2021 and a contract to be awarded a year later. But in the update DND also admits that timeline is tenuous. “The approved schedule is considered very aggressive,” it said. “The project team is managing a number of risks which have the potential to impact schedule.” The document doesn't outline the specific risks but DND officials have acknowledged that government negotiations with private contractors on the industrial benefits that are to be linked to the project could cause delays. The Liberals have committed to purchasing the new jets in a program expected to cost up to $19 billion. The competition was launched on Dec. 12, 2017, and Canada expects to examine four different fighter jets as candidates for the RCAF's new fleet. The project team is managing a number of risks which have the potential to impact schedule The first of the jets is expected to be delivered in the mid-2020s, with the full capability available in the early 2030s, according to the DND document. The document also outlines the plan to purchase used Australian F-18s in the interim, which the RACF will use to boost the capability of its current fleet of CF-18s until the new generation aircraft are in service. The first of the Australian jets has already been delivered, with final delivery set for the end of 2021, according to the update. However, the parliamentary budget officer has found this interim solution could cost more than $1 billion, and the auditor general's office has pointed out that the air force is lacking pilots and maintenance crews for the planes it already operates. Wednesday's DND update points out success stories as well as challenges with some of DND's multi-billion dollar projects. Some programs, such as the purchase of Chinook helicopters and tactical armoured patrol vehicles, are completed or are nearing completion with few problems. A new $2-billion program to buy heavy trucks is among those expected to be proceed without issues. Canada also expects to award a contact next year for a mid-life upgrade of the fleet of Cormorant search-and-rescue helicopters, and the conversion of former U.S. presidential helicopters so they can join the flight line for rescue operations. But the report warns there could be problems with other upcoming projects such as the purchase of a fleet of drones. It noted that there might not be enough procurement staff with the required expertise to move that program forward on schedule. The department hopes to deal with the problem by hiring contractors. A draft invitation to qualify for that project was released April 5 and a contact is expected to be awarded in 2022, the document said. The first of a fleet of new fixed-wing search-and-rescue aircraft, meanwhile, are to be delivered in December. The first plane will be sent to 19 Wing Comox, B.C. in the spring of 2020. The 16 new planes will be phased in between 2020 and 2022. But DND acknowledged it is keeping an eye on the potential that schedule could be affected because of the “complexities associated with transitioning to the new fleet while maintaining the current search and rescue posture.” In addition, DND is keeping watch on problems with its new upgraded light armoured vehicles. Though the vehicles have been delivered on time, some technical issues will be fixed through a retrofit program. There have also been problems with software design and qualification of components in another new fleet of armoured vehicles that will be used for battlefield surveillance, the first of which is to be delivered next year. The first new supply ship for the Royal Canadian Navy, being built in Vancouver, is expected in 2023 but won't be ready for operations until a year later. The delivery of the second supply ship “is currently under review,” the update added. In the meantime, the navy has access to MV Asterix, the supply ship at the heart of the court case involving Vice-Admiral Mark Norman.
