    German Defence Ministry punts key US defense-cooperation projects to the next government

    By: Sebastian Sprenger COLOGNE, Germany — The German Defence Ministry will leave planned air defense investments and other high-profile programs involving U.S. vendors unresolved in the final months of the Merkel government, officials have told lawmakers. A Feb. 3 list of “important” but unfunded programs, as officials wrote, includes several trans-Atlantic defense efforts that have been simmering for some time. As a result, American contractor behemoths Lockheed Martin and Boeing are left to wait until a new government re-litigates Germany's defense acquisition posture sometime after the Sept. 26 election. Lockheed Martin, along with MBDA Deutschland, has been gunning for a contract on the TLVS missile defense program following more than a year of negotiations and several years of German-American co-development. The program's prospects turned dimmer last fall, as new requirements drove up costs. Unsurprisingly, TLVS now officially appears on the to-do list for the next chancellor. Notably, a project aimed at defending against short-range aerial threats, like drones or mortar fire, is also lacking a budget, defense officials wrote to lawmakers. Defence Minister Annegret Kramp-Karrenbauer late last year reframed Germany's air defense requirements as needing greater focus on drone threats, as evidenced by the Nagorno-Karabakh conflict. She said a wholesale evaluation of the entire weapons portfolio would determine the way ahead, including what systems the Bundeswehr needs to counter threats of different sizes from various distances. Whatever happened with the review, it appears it did not spur an appetite to start something new soon. That leaves Germany's fleet of Patriot systems, along with a limited order of counter-drone systems made by Kongsberg and Hensoldt aimed at fulfilling Germany's commitment to NATO for 2023, as the baseline equipment for the time being. Lockheed also must wait for what happens next in the Bundeswehr's heavy transport helicopter program, which is meant to replace the fleet of CH-53G models. The Defence Ministry effectively halted the acquisition process last fall after Lockheed and Boeing went over budget with their custom offers of the CH-53K King Stallion and the CH-47 Chinook, respectively. German defense officials recently requested information from the U.S. Defense Security Cooperation Agency about buying more standard, and presumably cheaper, versions of the desired aircraft instead. In response, Lockheed launched a formal protest, which is now on the docket of the Federal Cartel Office, as newspaper Die Welt first reported. Company officials said they want to get a ruling of whether Berlin walking away from the purchase altogether was in line with fair-competition rules. German acquisition laws make it difficult for companies to protest when the government chooses not to award any contract at the end of a competition, said Christian Scherer, a public procurement expert with the law firm CMS Germany in Cologne. “Generally speaking, you can't force the government to buy anything,” he said. “But bidders might have compensation claims.” Judging offers as economically unfeasible, for example, could qualify as a valid reason for the government to withdraw, Scherer told Defense News. At the same time, there is a legal path if companies suspect abusive implementation of the rules, especially if the government's requirements remain the same, he added. Those rules exist to protect offerers against favoritism and other forms of manipulation. “You can't go ahead and compete the same thing with the intention to award the contract to your preferred bidder.” Finally, Germany's long-term campaign of replacing its fleet of Tornado combat aircraft will remain untouched during the final months of the Merkel era, according to the Defence Ministry. Defense officials last spring settled on a mixed fleet of mostly Eurofighters plus a smaller number of Boeing-made Super Hornets for electronic warfare and nuclear missions. The decision has morphed into something more akin to a mere recommendation that would require years to play out, leading Eurofighter maker Airbus to hold out hope that U.S. manufacturers can be entirely kept out of the business when all is said and done. Tobias Lindner, a Green Party member of the Budget and Appropriations committees in the Bundestag, said the list of unfunded programs is “almost more interesting” than the acquisitions considered doable by the time the Bundestag session ends in late June.     Start of Air Force’s light attack plane competition pushed back until next year

    By: Valerie Insinna WASHINGTON — If the Air Force moves forward on a proposed initiative to buy light attack planes, it won't happen by the end of 2018. The service intended to put out a final request for proposals this month for a potential light attack aircraft program, but the date has now slipped into 2019, an Air Force official confirmed Tuesday. “The Air Force does not anticipate release of the final Light Attack Request for Proposal by the end of the calendar year as we complete additional analysis,” said Air Force spokeswoman Capt. Hope Cronin in an emailed response to Defense News. The service released a draft solicitation on Aug. 3, following two experimentation campaigns that brought the Sierra Nevada Corp.-Embraer A-29 Super Tucano, Textron's Scorpion jet and AT-6 attack plane, and L3's AT-802L Longsword to Holloman Air Force Base in New Mexico for several rounds of test flights. The second set of flight experiments between the A-29 and AT-6 were curtailed this summer after an A-29 crashed, killing its pilot. However, the Air Force maintained that it could garner the data it needed on aircraft maintenance and network operations while testing the planes on the ground. Air Force acquisition officials have shied away from declaring whether a program of record will begin in the fiscal year 2020 budget, but the August presolicitation seems to limit the contenders to the A-29 and AT-6, stating that SNC and Textron “are the only firms that appear to possess the capability necessary to meet the requirement within the Air Force's time frame without causing an unacceptable delay in meeting the needs of the warfighter.” The goal of the light attack experiments is to prove whether the Air Force can quickly bring industry to the table to experiment with off the shelf equipment and rapidly make a decision about whether to buy it. In that light, the delay in releasing the final request for proposals is at least a slight setback, as it's unclear whether the wait for a final RFP could also push back the Air Force's proposed due date for awarding a contract — before the start of the 2020 fiscal year on Oct. 1. But it remains unclear whether the Air Force will have the money to buy it. Officials have maintained that a light attack capability is “additive," meaning that they would not be willing to sacrifice procurement dollars designated for aircraft in existing or planned programs of record so that it could buy the AT-6 or A-29. However, the Pentagon's topline budget is still uncertain. Defense Department budget officials had geared up for a $733 billion budget in FY20, only to have President Donald Trump call for a cut to $700 billion. Now, it appears that number is growing after intervention from Defense Secretary Jim Mattis and congressional hawks, and could be as high as $750 billion.     By: Jen Judson WASHINGTON — The Army has invited four teams to compete to build prototypes for its future light Robotic Combat Vehicle, according to an announcement on the National Advanced Mobility Consortium's website. Out of a large pool of white paper submissions, a Textron and Howe & Howe team, a team of Qinetiq North America and Pratt & Miller, HDT Global and Oshkosh were each issued a request for prototype proposal. The Army plans to procure a light, medium and heavy RCV as part of an effort to bring next-generation combat vehicle capability to the force by 2028. The RCV-Light competition is being managed by the NAMC. While the Army is the decision maker, the consortium is tasked to execute the competition and is also running the RCV-Medium effort. The Army is expected to award up to two contracts toward the end of the second quarter of this fiscal year to deliver four non-developmental RCV-L surrogate vehicles for government evaluation, testing and manned-unmanned teaming experimentation over the course of a year. The RCV-M effort is not far behind the RCV-L as white paper submissions are currently being evaluated for down-select. NAMC also executed a week-long RCV market research demonstration with the Army at Texas A&M's RELLIS campus in May in order to better inform requirements. Out of the companies chosen to move forward, only Oshkosh was not present at the event. At the Association of the U.S. Army's annual conference, Textron and Howe & Howe dramatically unveiled their RCV Ripsaw M5, which is based on Howe & Howe's deep history of building unmanned ground vehicles, but adds technology like scalable armor and suspension and drive options to cope with the challenges expected in the future fight. FLIR Systems is also part of the team, contributing advanced sensors. “Bringing together Howe & Howe, Textron Systems and FLIR Systems really represents a dream team,” Textron's CEO Lisa Atherton, said in a statement released at the show. “We formed this team based on our shared focus to serve this customer with disruptive ideas and proven experience, and we are dedicated to meeting and exceeding their requirements through the RCV program.” The team told Defense News before AUSA that it planned to submit a version of Ripsaw both for the light and medium variant of the Army's RCV. HDT brought its Hunter WOLF to AUSA, and Qinetiq North America announced its partnership with Pratt & Miller at the show. Qinetiq and Pratt & Miller plan to submit a variant of the Expeditionary Modular Autonomous Vehicle (EMAV) tailored for the Army's needs.
