    RCMP's ability to police digital realm 'rapidly declining,' commissioner warned

    Catharine Tunney · CBC News Organized crime is moving online and the Royal Canadian Mounted Police is struggling to keep up, according to a briefing note prepared for RCMP Commissioner Brenda Lucki when she took over the top job earlier this year. The memo, obtained by CBC News under access to information law,​ may launch a renewed battle between the national police service and privacy advocates. "Increasingly, criminality is conducted on the internet and investigations are international in nature, yet investigative tools and RCMP capacity have not kept pace," says the memo tucked into Lucki's briefing book. "Growing expectations of policing responsibilities and accountability, as well as complexities of the criminal justice system, continue to overwhelm the administrative demands within policing." In 2016 nearly 24,000 cybercrime-related cases were reported to Canadian police, up 58 per cent over 2014. The report's authors note that cybercrime tends to be under-reported. Encryption of online data has a been a persistent thorn in the RCMP's side. Lucki's predecessor lobbied the government for new powers to bypass digital roadblocks, including tools to get around encryption and warrantless access to internet subscriber information. "Approximately 70 per cent of all communications intercepted by CSIS and the RCMP are now encrypted ... 80 organized crime groups were identified as using encryption in 2016 alone," says the 274-page document. Some critics have noted that non-criminals — journalists, protesters and academics, among others — also use encryption tools online and have warned any new encryption legislation could undermine the security of financial transactions and daily online communication. Ann Cavoukian was Ontario's privacy commissioner for three terms; she now runs Ryerson University's Privacy by Design Centre of Excellence. She called the RCMP's push for more online policing power "appalling." "I guess we should remind them that we still live in a free and democratic society where people have privacy rights, which means that they should be in control of their personal information," she said. "If you're a law abiding citizen, you get to decide how your information is used and to whom it's disclosed. The police have no right to access your personal information online, unless of course they have a warrant." Lucki was specifically warned about criminal suspects "going dark," a term used to describe the gap between the lawful ability of police forces to obtain online evidence and changing technology. She also was advised the RCMP's court-authorized arsenal (things like court orders and "computer network exploitation techniques," which cover hacking) are "rapidly declining." "Get more efficient," said Cavoukian. Parliamentary committee promises to study issue A spokesperson for Public Safety Minister Ralph Goodale said that "encryption is critical to safeguarding our cybersecurity, privacy and the digital economy." "However, it has also created gaps for law enforcement and national security agencies," wrote Scott Bardsley in an email. Earlier this year, the House of Commons' public safety and national security committee released a 76-page report that recommended "no changes to the lawful access regime for subscriber information and encrypted information be made." But the committee didn't shelve the issue, promising instead to study the evolving challenges. "The government will support the standing committee on national security and public safety in its continued work to study these and other emerging technological issues related to cybersecurity," wrote Bardsley. "It will also continue to examine options to ensure agencies have the resources necessary to gain access to decrypted data required to address criminal activity." Cavoukian predicts "a real fight" over the issue. Bardsley says the government has pledged $116 million over five years, and $23.2 million per year after that, to help create the national cybercrime coordination unit, which would help "provide digital investigative advice and guidance to Canadian law enforcement." The RCMP didn't meet CBC's deadline for a comment. Attrition issues The briefing binder also flags the RCMP's persistent problem with replenishing its ranks when officers retire or otherwise leave the force. "The RCMP has a growing vacancy rate that exceeds its present ability to produce regular members at a rate that keeps pace with projected future demands," it warns. As of April 2018, there were 1,122 funded vacant regular member positions —a vacancy rate of 5.6 per cent. That's down slightly from the previous year, when the vacancy rate was 6.6 per cent. The briefing note says that in the last five years, there has been a "dramatic" increase in the number of new recruits needed to fill operational vacancies and evolving program requirements. About 1,280 cadets were expected to be enrolled in 2018-2019, up from 1,152 the previous year. In 2016, CBC News reported that the RCMP was dropping its requirement that applicants be Canadian citizens, and that it would accept applications from permanent residents. The RCMP also loosened entrance requirements to deal with a wave of retirements, low pay and the need to expand its pool of potential new officers. Starting this month, the RCMP is dropping its requirement that applicants must be Canadian citizens. It will now accept permanent residents. Post-secondary graduates no longer will have to write an entrance exam that measures aptitude for police work and the force will no longer require a physical abilities evaluation before people submit an application.     It's the mileage, not the years: Military says it plans to keep subs afloat past retirement dates

    Conservative critic says maintenance plan ignores fact that not everything on a submarine can be replaced Murray Brewster The Canadian navy has found a very creative way to keep its second-hand submarines afloat until the late 2030s and early 2040s — a plan that emphasizes maintenance over age in predicting how long the vessels can remain seaworthy. The plan — according to a newly-released briefing note prepared in the run-up to the release of the Liberal government's marquee defence policy — would not see HMCS Victoria decommissioned until the end of 2042, giving the warship over 45 years service in Canada. That estimate does not include the time the boat served with Britain's Royal Navy, which would add at least a decade to its working life. The retirements of the other submarines — HMCS Chicoutimi, HMCS Windsor and HMCS Corner Brook — would be staggered throughout the 2030s, with Windsor being the first to go in 2033. "The [Victoria Class Submarines] are a well-designed and solidly constructed class of modern conventional submarines that have had an unusual life since entering service with the [Royal Navy] in the early 1990s," said the August 2016 briefing analysis, recently obtained by Conservative Party researchers. "'While chronologically 20 years older, they have not been operated extensively during that time." The boats were first constructed for the Royal Navy in the 1980s, but Britain decided to sell them when the government of the day made the policy decision to operate only nuclear-powered submarines. One aspect of the Liberal defence policy, released in June 2017, that has puzzled military experts and opposition critics alike was its assumption that the submarines — which have had a tortured technical history that includes one fatal fire — will remain in service until at least the 2040s. The briefing note spells out in detail — and for the first time publicly — how the navy intends to squeeze more life out of boats it was supposed to start retiring in four years. It was originally envisioned, the briefing said, that the Victoria-Class submarines would retire one at a time, beginning in 2024. he report argues it is possible to operate the submarines beyond their expected working lives if the military assesses the "material state" of each boat rather than following "a simplistic calendar driven" evaluation of their operational condition. In others words, the report argues that what matters most is not how old the submarines are, but rather how hard have they been driven and how well have they been maintained. The submarines operate on what's called a "6-2 schedule" — six years of service at sea followed by two years of deep maintenance before returning to duty. The briefing note proposes that the boats do nine years of service and then go into a longer refurbishment of up to three years. The submarines would need a full life-extension overhaul in addition to the extended maintenance plan. As evidence to support the plan, the briefing note to senior defence officials pointed to a 2013 study of the Victoria-Class submarines — which said that "although there are numerous technical and supportability challenges, there was no single obstacle precluding a life extension of up to 12 years." 'Lower expectations' The briefing offers one note of caution, however: "It is reasonable to assume that operational availability will decrease as the submarine ages." The briefing note predicted higher maintenance and sustainment costs as the boats get older. To save money, it said, the navy might have to lower expectations of what the boats can do. The existing plan "assumed that there would be no relaxation of operational performance requirements, although in fact some discretion by the Operational Requirements Authority in this regard may be feasible as a cost saving measure," said the note. Conservative defence critic James Bezan said he was astounded by the plan to stretch out the operational life of the subs. He said he doesn't blame the naval planners who drew up the document — but he does hold the Liberal government accountable, arguing it must have ordered the Department of National Defence to give it some justification for putting off the purchase of new submarines. "It is ridiculous," Bezan said. "There was potential for some political direction on how this was written." Canada's submarine fleet spent 'zero days' at sea last year: government documents Canada's front-line frigates have suffered 10 fire and smoke incidents since 2018 In an interview with CBC News at the end of last year, the commander of the navy, Vice-Admiral Art McDonald, defended the plan to extend the life of the boats, saying he had full confidence in the "pretty resourceful and capable" submarine engineering community. The defence policy, he said, "directed us to operate and modernize" the submarine fleet and he's confident it can be done safely. "We know there is still excellent life in the Victoria-class submarine," McDonald told CBC News. "I've seen that personally as an outsider who has come into the program and taken a look at it." The focus of the subs' modernization project — which was in the early stages of being developed when the pandemic hit back in late winter — will be on survivability and making the submarines more livable for crew members. "We're going to be able to operate those boats into the 2030s, but to do that we have to continue with the routine investments we've made and modernize, as was directed" by the defence policy, McDonald said. Not everything can be replaced A series of assessments was conducted between 2008 and 2014. The defence department's naval board, which is charged with planning the future shape of the fleet, met in November 2014 to study the life expectancy of the second-hand boats. "While it is considered unrealistic to predict the material state of 40-year-old platforms, 20 years into the future, certain items such as the pressure hull and main motor will require additional monitoring and maintenance above the current regime, since unpredicted degradation in such areas may not be cost effective to repair and mitigate," said the 2016 briefing note. And that's the problem with the life-extension plan, said Bezan: some key parts of a submarine — such as the pressure hull and the engines — can't be upgraded. He also pointed to how the submarine fleet had "zero days at sea" in 2019 because all of the vessels were tied up for maintenance. The analysis, Bezan said, shows that the Liberal government should immediately begin looking for a replacement for the submarines — something the previous Conservative government was in the process of doing when it was defeated in 2015. The options that were discussed before the election, he said, included partnering with the Australians — who were in the process of acquiring their own submarine replacements — or buying an off-the-shelf design for inclusion in the federal shipbuilding strategy. Il sera adressé aux cinq constructeurs de quatre pays sélectionnés en février dernier : Boeing, Lockheed Martin, Dassault Aviation, Airbus Defense and Space et Saab AB. Le dossier de renouvellement de la flotte d'avions de combat canadiens arrive bientôt dans sa phase cruciale. Le Canada doit lancer au printemps 2019 un appel d'offres (RFP) pour l'acquisition de 88 avions de combat. Il sera adressé aux cinq constructeurs de quatre pays sélectionnés par Ottawa en février dernier : Boeing ainsi que Lockheed Martin associé à Pratt and Whitney (Etats-Unis), Dassault Aviation (avec Thales DMS France, Thales Canada, et Safran Aircraft Engines), Airbus Defense and Space (Grande-Bretagne) et Saab AB (Suède). Le vainqueur de la compétition, qui devra livrer le premier appareil en 2025 et les derniers en 2031, sera désigné fin 2021, début 2022. En novembre 2016, le Canada avait lancé un appel d'offres afin de moderniser sa flotte de combat tout en restant partenaire du programme F-35 de Lockheed Martin. Une décision qui allait à l'encontre de la promesse du gouvernement canadien faite en 2010 d'acquérir 65 F-35. Une intention d'achat qui n'a pas résisté à l'inflation des prix du F-35. Des F-18 d'occasion pour faire la jonction Où en est-on aujourd'hui? Après avoir lancé le processus en décembre 2017, puis désigné les constructeurs admissibles en février, Ottawa a remis la semaine dernière un projet d'appel d'offres aux six avionneurs. Ces derniers disposent d'un délai d'environ huit semaines pour envoyer leurs commentaires, qui seront utilisés par le Canada en vue de peaufiner et finaliser l'appel d'offres (RFP, Request for proposal). Une fois le document envoyé aux six constructeurs, ces derniers enverront leur proposition initiale au Canada à l'hiver 2019-2020. Ensuite, elles seront évaluées entre 2020 et 2021 et pourront faire l'objet d'une négociation si nécessaire. "Nous travaillerons avec les fournisseurs, au cours des mois à venir, sur cette ébauche, a expliqué Carla Qualtrough. La demande de propositions officielle sera distribuée aux fournisseurs admissibles le printemps prochain". En attendant la livraison du premier avion de combat en 2025, Ottawa travaille avec le gouvernement australien pour acheter 18 F-18 d'occasion et les pièces de rechange associées de la Royal Australian Air Force pour renforcer la flotte existante. "Nous prévoyons recevoir les deux premiers avions en 2019", a affirmé Carla Qualtrough. Initialement, le Canada avait prévu d'acheter des F-18 neufs à Boeing. Mais en décembre 2017, la ministre des Services publics a annoncé que le Canada n'a "pas l'intention de donner suite à l'offre du gouvernement américain pour des Super Hornet". Un contrat évalué à plus de 5 milliards de dollars qui passe sous le nez de Boeing en raison de la multiplication des conflits commerciaux avec les États-Unis. Play Video Des retombées technologiques et industrielles pour le Canada La nouvelle politique du Canada en matière de retombées industrielles et technologiques exige des groupes se voyant attribuer une commande dans la défense qu'ils investissent localement un montant égal à la valeur du contrat. Elle s'appliquera à l'appel d'offres des avions de combat. Les soumissionnaires seront donc invités à présenter leur meilleure proposition de valeur pour le Canada. Car ce critère a une influence directe sur le choix du vainqueur. À l'heure où le Canada amorce une période d'investissements importants dans la défense, le gouvernement a fixé une cible très ambitieuse de retombées économiques pour le pays. Il vise une augmentation de 40 % sur une période de dix ans des revenus de l'industrie de la défense canadienne. Les propositions seront également évaluées en fonction des coûts et des exigences techniques. Elles seront par ailleurs assorties d'une évaluation de l'incidence globale des soumissionnaires sur les intérêts économiques du Canada.
