    Pentagon declares defense contractors ‘critical infrastructure,’ must continue work

WASHINGTON — The U.S. Defense Department has declared that defense contractors are “critical infrastructure” to national security, a designation that comes with an expectation to maintain a consistent, normal work schedule amid the outbreak of the new coronavirus, COVID-19. In a Friday memo to industry, Undersecretary of Defense for Acquisition and Sustainment Ellen Lord made it clear that she wants defense companies to continue to deliver their products and services to the Pentagon on time. “If you work in a critical infrastructure industry, as designated by the Department of Homeland Security, you have a special responsibility to maintain your normal work schedule,” Lord wrote. “We need your support and dedication in these trying times to ensure the security of this Nation. I understand that this national emergency presents a challenge and we are dedicated to working closely with you to ensure the safety of the workforce and accomplishments of the national security mission.” Lord also spelled out large swaths of the industrial base for which this order applies, including the aerospace sector; mechanical and software engineers; manufacturing/production workers; IT support; security staff; security personnel; intelligence support; aircraft and weapon systems mechanics and maintainers; suppliers of medical suppliers and pharmaceuticals; and critical transportation. Included in the designation are personnel working for companies as well as subcontractors who perform under contract for the department. Contractors who perform tasks such as providing office supplies, recreational support or lawn care are not considered essential. By designating the defense industry in such a way, companies involved may be able to get around state-directed shutdowns such as the one in New York right now. Similarly designated workers include, among many others, law enforcement, health care providers, water and power authorities, and IT support for emergency services — all of whom are still on duty in the current crisis. In the memo, Lord noted, companies involved should “follow guidelines from the Centers for Disease Control and Prevention as well as State and local government officials regarding strategies to limit disease spread.” Some companies have instituted work-from-home policies where applicable, although in cases such as production of defense equipment or work in secure facilities, that option appears unrealistic. Force of law? Things may not be as cut and dry as Lord's memo makes it seem, warned Jeff Bialos, a partner with the Eversheds-Sutherland law firm and former deputy under secretary of defense for industrial affairs. He notes that Lord's memo is based on guidance, put out the day before by the Department of Homeland Security, which does not carry with it the force of law to override decisions on work stoppage that may come from a state. “These are guidelines only. They do not have the force of effect of law,” Bialos warned. Bialos thinks the memo may be a useful tool for industry to turn to local governments that are eyeing a work shutdown and say they should be given an exemption. But should the local government decide not to grant that exemption, how much force the memo may have is unclear. “Thee's no slam dunk here. Everyone is struggling with these issues. And I think what this memo does is put another arrow in the quiver of a company that wants to keep doing business to meet defense needs. And it also is a document companies can provide to localities and states, and say ‘please give us an exemption.'” In a statement released late Friday, Lt. Col. Mike Andrews, a spokesman for Lord, said the undersecretary met today with Senate Armed Services Committee chairman Sen. Jim Inhofe, R-Ok., on the memo and other issues. Lord “remains committed to daily communication and collaboration with the defense industrial base, especially the defense industry trade associations. In addition, she'll be contacting several state Governors to discuss state-specific critical infrastructure and essential workforce efforts,” Andrews said, adding that a daily call between members of Lord's team and industry associations continues. Jerry McGinn, a longtime official at the department's Office of Manufacturing and Industrial Base Policy, said the move was the right one to make. “You're essentially trying to keep that workforce engaged and supporting that customer. This is trying to give DoD organizations flexibility to reduce contract disruptions, stop-work orders, and other actions that could impact the contractor workforce” said McGinn, now executive director of the Center for Government Contracting at George Mason University. “And that in general is a good thing.     By: Valerie Insinna WASHINGTON — Lockheed Martin has scooped up a contract, worth up to $7.2 billion, for the latest batch of next-generation GPS satellites. The award decision comes as little surprise, as Lockheed Martin is the incumbent on the GPS III program responsible for manufacturing the first 10 satellites. It was also the sole bidder on the most recent contracting vehicle, which will span an additional 22 satellites. “The world is dependent on GPS, from getting directions to getting cash from an ATM machine or trading on the stock exchange,” said Air Force Secretary Heather Wilson in a statement. “These satellites will provide greater accuracy and improved anti-jamming capabilities, making them more resilient.” Three companies — Lockheed Martin, Boeing and Northrop Grumman —won Phase 1 contracts for the follow-one program in 2016 to perform feasibility studies, but the Boeing and Northrop Grumman dropped out of the competition. By THERESA HITCHENSon April 16, 2020 at 7:15 PM WASHINGTON: ‘Flying cars' using electric vertical takeoff and landing (eVTOL) technology could be in full-up production for Air Force use in moving cargo and people within three years, says Air Force acquisition head Will Roper. Such a capability, Roper enthused, would give the US military the ability to undertake missions “in three dimensions that we normally do in two,” giving the services “much greater agility.” This is why the Air Force program for investing in commercial firms now pursuing eVTOL vehicles is called “Agility Prime,” he noted. The Air Force will take a first look at vendor offerings in a virtual pitch event at the end of the month, with a focus on small eVTOL vehicles that could be used for missions involving transport of only a few people. Roper told reporters today that the size of any future Air Force vehicle buys would depend on what missions eVTOL vehicles prove capable of carrying out. “If it's helping us to do logistics at the edge, we could end up buying these in higher quantities. If it's things like security and rescue, it will be smaller quantities,” he explained. Roper has previously said he envisions large flying cars for carrying cargo, as well as smaller vehicles for Special Operations-type missions. But no matter what, Roper added that he expects that granting commercial producers Air Force safety certifications and allowing them to rack up flying hours under Agility Prime “will really help accelerate domestic use of these vehicles and [allow some companies to] get FAA certification sooner that it would have come if we had not interjected ourselves into the market.” The Agility Prime program will hold a “virtual launch event” April 27 to allow vendors to showcase their capabilities and interact with potential investors from both the private sector and the military, the Air Force Life Cycle Management Center (AFLCMC) announced earlier this week. Roper, who will give a keynote, said the event originally had been planned as a live demonstration of capabilities by chosen vendors at the annual South By Southwest music festival in Austin that was scheduled for March 13-22, but cancelled due to the COVID-19 pandemic. “The objective of the event is to reinforce the Air Force commitment to partnering with industry, investors, and the interagency to help ensure there is a robust domestic capability in this new aerospace sector,” AFLCMC explained. Agility Prime is designed as a “challenge” where eVTOL vehicle makers compete in a series of demonstration that ultimately could result in a contract for full-scale production. According to documents provided for potential competitors on the program website, the Air Force is asking potential vendors to be able to complete a flight test by Dec. 17. In the first round, companies will need to demonstrate the following specifications: Payload: 3-8 personnel Range: Greater than 100 miles Speed: Greater than 100 mph Endurance: Greater than 60 minutes Roper said the second round of the competition would be dedicated to larger vehicles for cargo, and multiple people. Agility Prime is a unique effort that involves a number of service entities working together, including AFLCMC, the Program Executive Office for Mobility, Air Force Research Laboratory (AFRL), the Air Force Warfighting Integration Capability (AFWIC) office, AFWERX, and the new AFVentures office that serves as an intermediary between vendors and venture capital providers. Roper said that besides helping to move the US into a prime spot in an emerging marketplace, he intends Agility Prime to also serve as an example to the commercial sector that the Air Force is serious about being “a good innovation partner.” One of the hallmarks of Roper's term as Air Force acquisition chief has been his focus on figuring out how to leverage commercial research and development to help DoD ensure that it can stay ahead of China in the pursuit of new technology — arguing that innovation is the new battlefield. https://breakingdefense.com/2020/04/roper-sees-air-force-flying-cars-in-production-by-2023
